RECOMMENDATION
Approve a Resolution authorizing the City Manager to sign tenant contracts and amendments for the Brentwood Education and Technology Center.

PREVIOUS ACTION
On February 26, 2002, City Council approved Resolution 2366 amending the City of Brentwood Master Fee Schedule revising the City’s Service Fees to include Information Systems set-up fee and copier fee for tenants at the Brentwood Education and Technology Center.

On September 18, 2001, City Council amended the City of Brentwood Master Fee Schedule Resolution No. 2366 as it relates to the Brentwood Education and Technology Center.

On September 25, 2001, City Council approved the Lease Agreement and Rent Structure for tenants at the Brentwood Education and Technology Center.

City Council authorized the City Manager to execute agreements, contracts and all necessary documents for the design, planning, engineering, construction, and construction management of the Brentwood Education and Technology Center (BETC) during fiscal years 2000/01 through 2001/02.

BACKGROUND
With the Brentwood Education and Technology Center coming into the Parks and Recreation Department in December 2004, a review of documents has found that City Council has not formally authorized the City Manager to sign Tenant Contracts and Amendments. As tenants come and go, contracts and amendments need an authorized signature. Approval of this Resolution will allow the City Manager to sign contracts and amendments. Any changes to fees and/or charges will still be required to be brought back to City Council for approval.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO SIGN TENANT CONTRACTS AND AMENDMENTS FOR THE BRENTWOOD EDUCATION AND TECHNOLOGY CENTER.

WHEREAS, the City Council authorized the City Manager to execute agreements, contracts and all necessary documents for the design, planning, engineering, construction, and construction management of the Brentwood Education and Technology Center (BETC) during fiscal years 2000/01 through 2001/02.

WHEREAS, the City Council approved the Lease Agreement and Rent Structure for tenants at the Brentwood Education and Technology Center; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the City Manager has authorization to sign tenant contracts and amendments for the Brentwood Education and Technology Center.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 8th day of February 2005 by the following vote:
