Subject/Title: Adopt a Resolution accepting Improvements for Brentwood Country Club, Pulte Home Corporation, Subdivision No. 8089 Phase B, located north of Concord Avenue and east of Fairview Avenue.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all on-site and off-site public improvements for maintenance including Concord Avenue and Creek Road trail and pedestrian bridge; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Brentwood Country Club, Pulte Home Corporation Subdivision No. 8089 Phase B, located north of Concord Avenue and east of Fairview Avenue.

PREVIOUS ACTION
On August 15, 2000, by Resolution No. 00-47, Planning Commission approved Vesting Tentative Subdivision Map No. 8089, with conditions.

On June 4, 2002, by Resolution No. 02-32, Planning Commission approved an Amendment to Vesting Tentative Subdivision Map No. 8089, with conditions.

On February 25, 2003, by Resolution No. 2802, City Council approved Final Subdivision Map No. 8089, accepting the improvement securities and approving the Subdivision Improvement Agreement.

On June 22, 2004 by Resolution 2004-145, City Council accepted public improvements for Brentwood Country Club, Pulte Home Corporation, Subdivision No. 8089 Phase A.

BACKGROUND
This subdivision, located north of Concord Avenue and east of Fairview Avenue, contains 249 active adult residential lots. All on and off-site public improvements required by the conditions of approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, paving, sidewalk, streetlights and fiber optics. This project was also responsible for off-site improvements including construction of the pedestrian bridge over the ECCID main canal (just west of Marsh Creek) and continuation of the trail at Creekside Park south to Concord Avenue, widening of Concord Avenue from Fairview Avenue to Walnut Boulevard and widening of the Concord Avenue/Walnut Boulevard intersection to provide protected left turns from Walnut Boulevard to Concord Avenue. Pulte Home Corporation has provided a Maintenance Bond to cover the twelve-month warranty period for the improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 4,409 LF of 8” sewer line, 4,414 LF of 8” water lines, 3,069 LF of 18” storm drain, 9,787 LF of curb and gutter, 19,865 LF of 4’ wide sidewalk, 4,250 LF of pavement, 31 streetlights and 4,414 LF of joint trench conduit. The streets and sidewalks within this subdivision will be privately maintained by the Homeowner’s Association, with the City maintaining the utilities, pedestrian bridge and trail landscaping.

When the Final Map was approved by the City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the public improvements, right-of-ways, parcels and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $14,000, associated with necessary maintenance of utilities and public landscaping. The in-tract roadways are private and will be maintained by the Summerset Home Owners Association, off-site Concord Avenue and Walnut Boulevard are outside of the City limits and therefore will be maintained by Contra Costa County. The sewer and water maintenance will be funded through their respective enterprise funds and Landscaping and Lighting Assessment District (LLD) No. 94-1 has been formed for this subdivision to be responsible for public landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL ON AND OFF-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR BRENTWOOD COUNTRY CLUB, PULTE HOME CORPORATION SUBDIVISION NO. 8089 PHASE B, LOCATED NORTH OF CONCORD AVENUE AND EAST OF FAIRVIEW AVENUE.

WHEREAS, on August 15, 2000, by Resolution No. 00-47, Planning Commission approved Vesting Tentative Subdivision Map No. 8089, with conditions; and

WHEREAS, on June 4, 2002, by Resolution No. 02-32, Planning Commission approved an amendment to Vesting Tentative Subdivision Map No. 8089 with conditions; and

WHEREAS, on February 25, 2003, by Resolution No. 2802, City Council approved Final Subdivision Map No. 8089, accepting the improvement securities and approving the Subdivision Improvement Agreement; and

WHEREAS, on June 22, 2004, by Resolution No. 2004-145, City Council accepted the public improvements for Subdivision No. 8089 Phase A; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that all on and off-site public improvements for maintenance and all offers of dedication for right-of-ways, easements and parcels of land intended for public use as shown on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
