Approve a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the Final Map; accepting all public improvements for
maintenance; accepting the Subdivision Maintenance Bond and releasing the
Subdivision Improvement Securities for Brentwood Country Club, Pulte Homes
Subdivision No. 7940, located south of Balfour Road and west of Fairview
On December 16, 1997, by Resolution No. 97-39, Planning Commission approved
Tentative Subdivision Map No. 7940, with conditions.
On February 10, 1998, by Resolution No. 98-31, City Council upheld Planning
Commission Resolution 97-39, approving Tentative Subdivision Map 7940
subject to revisions.
On April 27, 1999, by Resolution No. 99-109, City Council approved Final
Subdivision Map No. 7940, accepting the improvement securities and approving
the Subdivision Improvement Agreement.
This subdivision, located south of Balfour Road and west of Fairview Avenue,
contains 180 active adult residential lots. All on and off-site public
improvements required by the conditions of approval for this subdivision
have been constructed and inspected for conformance with the approved
improvement plans including sewer, water and storm drain lines, paving,
sidewalk, streetlights and fiber optics. Pulte Homes has provided a
Maintenance Bond to cover the twelve-month warranty period for the
As required by the conditions of approval and shown on the improvement
plans, the Developer has installed the following improvement quantities:
3,741 LF of 24” sewer main, 10,142 LF of 8” sewer lines, 1,236 LF of 24”
water main, 886 LF of 12” water main, 10,113 LF of 8” water lines, 12,100 LF
of various diameter storm drain lines ranging from 54” to 18”, 27,732 LF of
curb and gutter, 15,214 LF of 5’ wide sidewalk, 50,919 LF of 4’ wide
sidewalk, 10,081 LF of pavement, 78 streetlights and 11,700 LF of joint
trench conduit. The streets and sidewalks within this subdivision will be
privately maintained by the Homeowner’s Association, with the City
maintaining only the utilities.
When the Final Map was approved by City Council, the right-of-way offers of
dedication were accepted subject to acceptance of improvements. The
improvements are now installed to support the new lots; therefore, it is the
appropriate time to accept the public improvements, rights-of-way and
easements as offered on the Final Map.
Upon acceptance of improvements the City will incur annual costs in the
amount of approximately $20,000, associated with necessary maintenance of
utilities and public landscaping. The sewer and water maintenance will be
funded through their respective enterprise funds and Landscaping and
Lighting Assessment District (LLD) No. 94-1 has been formed for this
subdivision to be responsible for public landscape maintenance.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE
RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S
RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP;
ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION
MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR
BRENTWOOD COUNTRY CLUB, PULTE HOMES SUBDIVISION NO. 7940, LOCATED SOUTH OF
BALFOUR ROAD AND WEST OF FAIRVIEW AVENUE.
WHEREAS, on December 16, 1997, by Resolution No. 97-39, Planning Commission
approved Tentative Subdivision Map No. 7940, with conditions; and
WHEREAS, on February 10, 1998, by Resolution No. 98-31, City Council upheld
Planning Commission Resolution 97-39, approving Tentative Subdivision Map
7940 subject to revisions; and
WHEREAS, on April 27, 1999, by Resolution No. 99-109, City Council approved
Final Subdivision Map No. 7940, accepting the improvement securities and
approving the Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and
constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
that the public improvements for maintenance and all offers of dedication
for rights-of-way, easements and parcels of land intended for public use as
shown on the Final Maps are hereby accepted.
BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against
defects in material and workmanship for a period of twelve months are hereby
BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds
will be released within sixty (60) days of the passage of this Resolution.
BE IT FURTHER RESOLVED that the City Council of the City of Brentwood
directs the City Clerk to file this Resolution with the Recorder of Contra
