REDEVELOPMENT AGENCY AGENDA ITEM NO. 2

Subject/Title: Approve the Purchase Agreement for the sale of a portion of Agency-owned property located on Walnut Boulevard, south of Oak Street, for Walnut Boulevard Widening, CIP Project No. 336-3056.

RECOMMENDATION
Approve the Purchase Agreement for the sale of a portion of Agency-owned property to the City of Brentwood for real property identified as APN 013-232-006 generally located on Walnut Boulevard, south of Oak Street, for the Walnut Boulevard Widening, CIP Project No. 336-3056, and authorize Executive Director or his designee to execute the Purchase Agreement and Grant Deed hereby conveying Agency-owned property to the City and any other such documents that may be necessary to complete the transaction including the Temporary Construction Easement.

PREVIOUS ACTION
On March 31, 1988, the Redevelopment Agency purchased property located on Oak Street and Walnut Boulevard and identified as APN 013-232-006. This property is held for possible assemblage and conveyance for future retail/office/residential development.

On May 27, 2003, the City Council adopted the 2003/2004 - 2007/2008 Capital Improvement Program. This program includes the Walnut Boulevard Widening, CIP Project No. 336-3056. This Project will improve the north and south bound vehicular commute traffic by including 2,300 linear feet of widened street and asphalt concrete overlay, installation of curbs, gutters and sidewalk, plus installation of 2,300 linear feet of storm drain, sewer, water and fiber optic conduit systems.

BACKGROUND
The City of Brentwood proposes to acquire two strips of land along Walnut Boulevard frontage from the Brentwood Redevelopment Agency to allow for the widening of Walnut Boulevard and completion of CIP Project No. 336-3056. One required strip contains 1,352 square feet (Parcel 1008-1); the other is to the south and contains 329 square feet (Parcel 1008-2), which overlaps the existing easement for the underground pipeline. Also required for the roadway widening, is an approximately ten-foot wide temporary construction easement (TCE) containing 193 square feet (Parcel 1008-3). (See attached plat map.)

FISCAL IMPACT
The Agency shall receive revenue of $7,750 for the property and temporary construction easement. The City shall pay all escrow, recording and title insurance charges, if any, incurred in this transaction.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD APPROVING A PURCHASE AGREEMENT AND GRANT DEED FOR THE SALE OF AGENCY-OWNED PROPERTY AND TEMPORARY CONSTRUCTION EASEMENT GENERALLY LOCATED ON THE EAST SIDE OF WALNUT BOULEVARD, SOUTH OF OAK STREET, AND IDENTIFIED AS PARCELS 1008-1, 1008-2 AND 1008-3 IN SAID PURCHASE AGREEMENT BEING PORTIONS OF APN 013-232-006 (“PROPERTY”), TO THE CITY OF BRENTWOOD FOR ROADWAY WIDENING PURPOSES IN THE AMOUNT OF $7,750, FOR THE WALNUT BOULEVARD WIDENING, CIP PROJECT NO. 336-3056, AND AUTHORIZE THE EXECUTIVE DIRECTOR OR HIS DESIGNEE TO EXECUTE THE PURCHASE AGREEMENT AND GRANT DEED HEREBY CONVEYING REAL PROPERTY ON BEHALF OF THE AGENCY TO THE CITY, AND TO EXECUTE SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING THE TEMPORARY CONSTRUCTION EASEMENT.

BE IT FURTHER RESOLVED, that the Redevelopment Agency of the City of Brentwood approves a Purchase Agreement and Grant Deed for the sale of Agency-owned property and Temporary Construction Easement generally located on the east side of Walnut Boulevard, South of Oak Street, and identified as parcels 1008-1, 1008-2 and 1008-3 in said Purchase Agreement being portions of APN 013-232-006 (“PROPERTY”), to the City of Brentwood for roadway widening purposes in the amount of $7,750 for the Walnut Boulevard Widening, CIP Project No. 336-3056, and authorize the Executive Director or his designee to execute the Purchase Agreement and Grant Deed hereby conveying real property on behalf of the Agency to the City, and to execute such other documents as may be needed to complete the transaction including the Temporary Construction Easement.

PASSED, APPROVED AND ADOPTED by the Redevelopment Agency of the City of Brentwood at a regular meeting held on the 14th day of December 2004 by the following vote:
