RECOMMENDATION
Approve a Resolution accepting improvements constructed as a part of CIP Project No. 336-3127, Lone Tree Way Widening Project – Segment 2, between Empire Avenue and Fairview Avenue.

PREVIOUS ACTION
On February 27, 2001, by Resolution No. 2246, City Council approved the Northwest Quadrant Infrastructure Design Engineering Fee Reimbursement Agreement. The City Engineer was directed to sign contracts with the design consultants for the designated Northwest Quadrant public infrastructure and to direct those consultants to begin the design process.

On May 28, 2002, by Resolution No. 2549, City Council adopted the City’s 2002/03 -2006/07 Capital Improvement Program that included the Northwest Quadrant Infrastructure, CIP Project No. 336-3127.

On July 9, 2002, by Resolution No. 2613, City Council certified the Mitigated Negative Declaration for the Lone Tree Way Widening Project, a portion of the Northwest Quadrant Infrastructure, CIP Project No. 336-3127.

On August 27, 2002, by Resolution No. 2649, City Council executed a Contract with Pacific Gas and Electric (PG&E) for the undergrounding of the existing 21 kV Overhead Distribution Power Line along Lone Tree Way between Jeffery Way and Fairview Avenue for CIP Project No. 336-3127.

On September 24, 2002, by Resolution No. 2678, City Council approved the Agreement with Brentwood Partners, LLC., to provide reimbursement for a portion of the Lone Tree Way Widening Project – Segment 2, between Empire Avenue and Fairview Avenue, CIP Project 336-3127.

On November 12, 2002, by Resolution No. 2729, City Council approved the Agreement with the City of Antioch to provide payment of Brentwood’s portion of the Lone Tree Way Widening Project – Segment 1, between Jeffery Way and Empire Avenue, CIP Project No. 336-3127.

On May 27, 2003, by Resolution No. 2868, City Council adopted the City’s 2003/04 -2007/08 Capital Improvement Program that included the Northwest Quadrant Infrastructure, CIP Project No. 336-3127.

On May 25, 2004, by Resolution 2004-113, City Council approved the 2004/05 – 2008/09 Capital Improvement Program, including the current budget for the Lone Tree Way Widening Segments 1 & 2, CIP Project No. 336-3127.

BACKGROUND
The Lone Tree Way Segments 1 and 2 improvements (formerly known as the Northwest Quadrant Improvements) include the phased construction of major street, sewer, water, and storm drain facilities required to serve development of the Northwest Quadrant of the City.

The City Council approved the reimbursement agreement with Brentwood Partners, L.L.C., on September 24, 2002, for the construction of the Segment 2 improvements and subsequently approved the reimbursement agreement with the City Antioch on November 12, 2002, for the construction of the Segment 1 improvements. At this time the Segment 2 improvements are complete and operational, and have been inspected for conformance with the approved improvement plans.

The following is the scope of improvements constructed; these listed improvements will be maintained by the City upon acceptance:

 Lone Tree Way: approximate 2,640 LF of 6 lane roadway with median including curb and gutter, sidewalk, signing and striping, traffic signal, controller, signal interconnect system, street lights, various diameter storm drain lines ranging from 18” to 84”, inlets and manholes, various diameter sanitary sewer lines, various diameter water lines, valves and fire hydrants.
 Fairview Avenue Realignment: approximate 1,056 LF of 2 lane roadway with median including curb and gutter, sidewalk, 6’ soundwall, signing and striping, traffic signal at Lone Tree Way, various diameter storm drain, various diameter sanitary sewer lines, various diameter water lines.
 Fairview Avenue Detention Basin: 11 acre basin and appurtenant facilities.
 Joint Trench Segment 1 and Segment 2: 62,900 LF of PG&E and 39,400 LF of SBC utilities and appurtenant facilities, 21,300 LF of fiber optics.

Construction costs for the portion being accepted at this time totals $6,764,855.30 with funding through developer contributions, assessment district proceeds, reimbursements from the City of Antioch as well as proceeds from the sale of excess property purchased in conjunction with the project. Upon acceptance of improvements the City will incur annual costs in the amount of approximately $40,000, associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Various Landscaping and Lighting Assessment Districts have been formed through adjacent developments and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING IMPROVEMENTS CONSTRUCTED AS A PART OF CIP PROJECT NO. 336-3127, LONE TREE WAY WIDENING PROJECT – SEGMENT 2, BETWEEN EMPIRE AVENUE AND FAIRVIEW AVENUE.

WHEREAS, on July 9, 2002, by Resolution No. 2613, City Council certified and adopted the Mitigated Negative Declaration for the Lone Tree Way Widening Project, a portion of the Northwest Quadrant Infrastructure, CIP Project No. 336-3127; and

WHEREAS, on May 25, 2004, by Resolution 2004-113, City Council approved the 2004/05 – 2008/09 Capital Improvement Program, including the current budget for the Lone Tree Way Widening Segments 1 & 2, CIP Project 336-3127; and

WHEREAS, on September 24, 2002, by Resolution No. 2678, City Council approved the Agreement with Brentwood Partners, LLC., to provide reimbursement for a portion of the Lone Tree Way Widening Project – Segment 2, between Empire Avenue and Fairview Avenue, CIP Project 336-3127; and

WHEREAS, the required public improvements for a portion of CIP Project No. 336-3127 including Lone Tree Way Widening Segment 2, Realigned Fairview Avenue, and Joint Trench Utilities for Segments 1 and 2 have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance; and

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
