RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute contract change orders up to 11% of the contract amount to Granite Construction Co. for the Lone Tree Way Overlay/ Improvements, CIP Project No. 336-3130.

PREVIOUS ACTION
City Council approved the 2004/05 - 2008/09 Capital Improvement Program (CIP) for the City of Brentwood, which included the Lone Tree Way Overlay/Improvements, CIP Project No. 336-3130.

On September 14, 2004, City Council approved Resolution No. 2004-220, approving the contract documents and awarding the construction contract for the Lone Tree Way Overlay/Improvements, CIP Project No. 336-3130, to Granite Construction Co. in the amount of $219,985.00 plus a 10% contingency.

BACKGROUND
The existing pavement on Lone Tree Way between O’Hara Avenue and Brentwood Boulevard was distressed due to utility improvements and age. Overlaying the roadway will prevent the need to replace the entire roadway in the future at a significantly higher cost. The City’s Pavement Management Program identifies this roadway as a high priority for overlay at this time.

In addition to overlaying the roadway, the engineering work required the repair of several areas of pavement failures by performing dig outs and 1.35’ deep lift AC replacement. During the construction of the pavement failure repairs, additional failures were identified and repaired, resulting in a significant increase in the contract item quantity for dig outs and deep lift AC replacement. As a result of this quantity increase, the cost of doing the repairs will exceed the 10% contingency budget, costing an additional $2,170.53.

The City has applied for and been awarded a Federal Surface Transportation Program (STP) grant for this project. The funds from this grant, as well as funds transferred from another federally funded project, are in the amount of $586,000.

The construction contract for the Lone Tree Way Overlay/Improvements, CIP Project No. 336-3130, was awarded to Granite Construction Co., Inc. for the amount of $219,985.00, plus 10% contingencies, for a total contract amount of $241,983.50. Staff recommends that the contingencies be increased to 11% for a total contract amount of $244,183.35.
FISCAL IMPACT
The funds associated with this work are included in the Capital Improvement Program 2004/05 - 2008/09 Capital Improvement Program and the construction budget contains $545,000 in funds for the construction of the Lone Tree Way Overlay/Improvements, CIP Project No. 336-3130, and the low bid amount of $219,985.00 is less than the budgeted amount.

By approving the change of the contingency amount from 10% to 11%, the total contract amount will increase from $241,983.50 to $244,183.35 for an increase of $2,199.85. There are sufficient funds in the CIP budget for the Lone Tree Overlay/Improvements, CIP Project No. 336-3130, in the amount of $244,183.35.

This project is primarily funded by Federal Funds in the amount of $194,840.71.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO AUTHORIZE THE CITY MANAGER TO EXECUTE CONTRACT CHANGE ORDERS UP TO 11% OF THE CONTRACT AMOUNT TO GRANITE CONSTRUCTION CO. FOR THE LONE TREE WAY OVERLAY/IMPROVEMENTS, CIP PROJECT NO. 336-3130.

WHEREAS, City Council approved the 2004/05 - 2008/09 Capital Improvement Program (CIP) for the City of Brentwood, which included the Lone Tree Way Overlay/Improvements, CIP Project No. 336-3130; and

WHEREAS, on September 14, 2004, City Council approved Resolution No. 2004-220, approving the contract documents and awarding the construction contract for the Lone Tree Way Overlay/Improvements, CIP Project No. 336-3130, to Granite Construction Co.; and

WHEREAS, during the construction of the pavement failure repairs, additional failures were identified and repaired, resulting in a significant increase in the contract item quantity for dig outs and deep lift AC replacement; and

WHEREAS, as a result of this quantity increase, the cost of doing the repairs will exceed the 10% contingency budget, costing an additional $2,170.53, bringing the total construction contract amount to $244,183.35; and

WHEREAS, the total project cost falls within the approved 2004/05-2008/09 Capital Improvement Program construction line item budget for the Lone Tree Way Overlay/ Improvements, CIP Project No. 336-3130.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the City Manager is authorized to execute contract change orders up to 11% of the contract amount to Granite Construction Co. for the Lone Tree Way Overlay/Improvements, CIP Project No. 336-3130.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 14th day of December 2004 by the following vote:
