Subject/Title: Approve a Resolution accepting the Zone II Hydropneumatic Pump Station constructed by Home Depot, Inc. as part of Design Review No. 01-30/Subdivision No. 8515, located at the southeast corner of Lone Tree Way and Heidorn Ranch Road.

RECOMMENDATION
Approve a Resolution accepting the in-fee offer of dedication for Parcel 9 of Subdivision No. 8515, accepting the Zone II Hydropneumatic Pump Station for maintenance; accepting the Maintenance Bond and releasing the Improvement Securities provided as a part of Lone Tree Plaza, Design Review No. 01-30/Subdivision No. 8515, located at the southeast corner of Lone Tree Way and Heidorn Ranch Road.

PREVIOUS ACTION
On June 26, 2002, by Resolution No. 02-39, Planning Commission approved Design Review No. 01-30 and Subdivision No. 8515, with conditions.

On April 8, 2003, by Resolution No. 2823, City Council approved Final Map Subdivision No. 8515, accepting the improvement securities and approving the Subdivision Improvement and Reimbursement Agreement.

BACKGROUND
This project, located at the southeast corner of Lone Tree Way and Heidorn Ranch Road, was approved for commercial and office space on the existing 76 acres adjacent to the Highway 4 ByPass. As a part of the project, the Developer was conditioned to build the Zone II Hydropneumatic Pump Station that was necessary to supply water to this large commercial development and to also serve the City’s Northwest Quadrant. At this time the pump station is complete and operational, and has been inspected for conformance with the approved improvement plans. The developer/contractor, Home Depot, Inc., has posted a Maintenance Bond to cover the twelve-month warranty period for the improvements

The pump station contains the following major improvements to be maintained by the City upon acceptance: 2 - 700 gpm Turbine Booster Pumps, 1 - 4,000 gmp Fire Service Turbine Booster Pump, 25,000 gallon Hydropneumatic Tank and an emergency generator.

The in-fee offer of dedication for the parcel upon which the pump station is located, was made to the City with the final map of Subdivision No. 8515. The improvements are now installed and the pump station is operational to serve the northwest quadrant and City’s Zone II water system; therefore, it is the appropriate time to accept the improvements for maintenance.


FISCAL IMPACT
Upon acceptance of improvements the City will incur costs in the amount of approximately $15,000 annually; these costs may increase upon build-out of the Northwest Quadrant. The costs are associated with routine site visits, utilities and necessary maintenance of the pumps and tank, and will be covered through the water enterprise fund.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE IN-FEE OFFER OF DEDICATION FOR PARCEL 9 OF SUBDIVISION NO. 8515; ACCEPTING THE ZONE II HYDROPNEUMATIC BOOSTER PUMP STATION FOR MAINTENANCE; ACCEPTING THE MAINTENANCE BOND AND RELEASING THE IMPROVEMENT SECURITY FOR THE PUMP STATION CONSTRUCTED AS A PART OF THE OFF-SITE IMPROVEMENTS FOR DESIGN REVIEW NO. 01-30, LOCATED AT THE SOUTHEAST CORNER OF LONE TREE WAY AND HEIDORN RANCH ROAD.

WHEREAS, on June 26, 2002, by Resolution No. 02-39, Planning Commission approved Design Review No. 01-30 and Subdivision No. 8515, with conditions; and

WHEREAS, on April 8, 2003, by Resolution No. 2823, City Council approved Final Map Subdivision No. 8515, accepting the improvement securities and approving the Subdivision Improvement and Reimbursement Agreement; and

WHEREAS, the Zone II Hydropneumatic Pump Station improvements have been constructed and completed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the in-fee offer of dedication for Parcel 9 of Subdivision No. 8515 intended for public use as shown on the Final Map is hereby accepted.

BE IT FURTHER RESOLVED that the Zone II Hydropneumatic Pump Station improvements are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
