Approve a resolution authorizing submittal of a grant proposal for partial
funding of the Sand Creek Road East B Landscape Project, no CIP number
assigned, to the State of California Resources Agency FY 05/06 Environmental
Enhancement and Mitigation Program, (EEMP), and authorizing the City
Engineer to execute and submit all documents which may be necessary for the
completion of the project.
Resolution No. 2736 authorizing submittal of a grant proposal to the State
of California Resources Agency FY 03/04 Environmental Enhancement and
Mitigation Program (EEMP) for Sand Creek Road Central, CIP 336-3061, was
approved by City Council on November 12, 2002.
Resolution 2004-13 authorizing submittal of a grant proposal to the State of
California Resources Agency FY 04/05 Environmental Enhancement and
Mitigation Program (EEMP) for Sand Creek Road East, CIP 336-3061, was
approved by City Council on January 13, 2004.
The Transportation Blueprint Legislation of 1989 established the
Environmental Enhancement and Mitigation Program using State gasoline tax
monies to fund it. The Program offers grants each year to local, state and
federal governmental agencies and to non-profit organizations for projects
to mitigate the environmental impacts caused by new or modified state and
local transportation facilities. The projects funded by this program must
provide mitigation or enhancement in addition to the mitigation required as
part of the transportation project to which they are related.
Due to the state budget constraints the program was at first totally
eliminated and then reinstated at a lower level of funding during the past
two fiscal years. Grant proposals were submitted for Sand Creek Road
landscaping during these years but were not selected for funding due to the
cuts in the program. The Engineering Department requested preparation of a
third proposal for landscaping on Sand Creek Road East since the project is
still in need of funding
The proposal will request funds for irrigation and landscaping installation
within the public road right of way. The Community Design Element of the
City of Brentwood General Plan 2001-2021 designates Sand Creek Road as one
of the “gateway routes” into the City where design criteria call for special
landscape treatment. The grant will help augment City funds for the
The project estimate without contingencies is $516,887 of which the EEM
Program will fund a maximum of $250,000. The remainder of the project cost
is the responsibility of the City and has been allocated from Facility Fees
in the approved budget for Sand Creek Road East B Widening/Landscaping.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE
APPLICATION FOR GRANT FUNDS FROM THE ENVIRONMENTAL ENHANCEMENT AND
MITIGATION PROGRAM UNDER SECTION 164.56 OF THE STREETS AND HIGHWAYS CODE FOR
THE HIGHWAY LANDSCAPING AND URBAN FORESTRY ON SAND CREEK ROAD EAST PROJECT,
CIP 336-3061, AND AUTHORIZING THE CITY ENGINEER TO EXECUTE AND SUBMIT ALL
DOCUMENTS WHICH MAY BE NECESSARY FOR THE COMPLETION OF THE PROJECT.
WHEREAS, the Legislature of the State of California has enacted AB 471
(Chapter 106 of the Statutes of 1989), which is intended to provide $10
million annually for a period of 10 years for grant funds to local, state
and federal agencies and nonprofit entities for projects to enhance and
mitigate the environmental impacts of modified or new public transportation
WHEREAS, the Resources Agency has established the procedures and criteria
for reviewing grant proposals and is required to submit to the California
Transportation Commission a list of recommended projects from which the
grant recipients will be selected; and
WHEREAS, said procedures and criteria established by the Resources Agency
require a resolution certifying the approval of application by the City
Council before submission of said application to the State; and
WHEREAS, the application contains assurances that the City of Brentwood must
comply with; and
WHEREAS, the City of Brentwood, if selected, will enter into an agreement
with the State of California to carry out the environmental enhancement and
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood
1. Approves the filing of an application for the Environmental Enhancement
and Mitigation Program for grant assistance.
2. Certifies that the City of Brentwood will make adequate provisions for
operation and maintenance of the project.
3. Appoints the City Engineer as agent of the City of Brentwood to conduct
all negotiations, execute and submit all documents, including, but not
limited to applications, agreements, amendments, payment requests and so on,
which may be necessary for the completion of the aforementioned project.
