Subject/Title: Approve a Resolution authorizing the City Manager to execute a change order with Gray Bowen and Company, Inc. for regional transportation related assistance including Vasco Road safety and strategic planning advice and assistance.

RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a change order in an amount not to exceed $40,000 with Gray Bowen and Company, Inc. for regional transportation related assistance including Vasco Road safety and strategic planning advice and assistance.

PREVIOUS ACTION:
On February 13, 2001, City Council authorized the City Manager to execute a contract with Gray Bowen and Company, Inc. formerly William R. Gray and Associates, to continue the traffic related assistance provided to the City, specifically relating to Vasco Road safety.

On July 23, 2002, City Council authorized the City Manager to award a professional services contract to Gray Bowen and Company, Inc. for transportation related assistance including the Route 4 transfer and relinquishment process, Vasco Road safety and strategic planning.

On June 22, 2004, City Council authorized the City Manager to execute a contract term amendment extending the termination date from July 23, 2004 to June 30, 2006.

BACKGROUND
For many years, Gray Bowen and Company, Inc. has provided assistance to the City of Brentwood on a number of regional transportation issues by acting as a voice of the City and representative to Caltrans and other agencies. This consultant has a skilled staff that will continue to assist the City with very complex transportation issues. One of the more complex issues they are working on is the transfer and relinquishment of the existing Route 4 from Caltrans, to City of Brentwood, City of Oakley and Contra Costa County. Both cities and county have agreed to retain this consultant for this job to have better coordination and joint effort. As this will be a very long involved process including strategic planning meetings, a magnitude of paperwork preparing estimates, technical reports and coordination with Caltrans, staff has requested that this issue be handled under a separate contract from the one being proposed in this staff report. In the past two years, this consultant has worked with representatives of the business and environmental communities, representatives of Alameda County and the City of Livermore regarding the realignment of Vasco Road in Alameda County to tie-in with a new proposed interchange on I-580. They have worked with local, state and federal representatives to identify the process required to expand the capacity of Vasco Road to have it adopted as a state highway (State Route 84). Their work with Senator Torlakson and Assemblyman Guy Houston to include the Vasco Road Corridor in his SB 802 has allowed projects in the corridor to be eligible for state Interregional Transportation Improvement Program (ITIP) funds. Vasco Road is a project that needs extensive coordination between the cities of Brentwood and Livermore and the counties of Contra Costa and Alameda to facilitate the planning, design, construction and above all, the financing for this much needed regional project. This consultant has made progress in this area and has a productive track record. Staff recommends continuing the professional relationship between the City of Brentwood and Gray Bowen and Company, Inc.

FISCAL IMPACT
The new contract amount with Gray Bowen and Company, Inc., including this $40,000 change order, will total $105,000. Since July of 2002, we have expended approximately $58,000 of the original $65,000 contract. We anticipate that the $7,000 balance, in addition to this $40,000 change order, will carry us through the term of the contract, which expires on June 30, 2006. The Funding for this contract is budgeted within Engineering’s transportation and Capital Improvement divisions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER WITH GRAY BOWEN AND COMPANY, INC. NOT TO EXCEED $40,000 FOR REGIONAL TRANSPORTATION ASSISTANCE INCLUDING VASCO ROAD SAFETY AND STRATEGIC PLANNING ADVICE AND ASSISTANCE.


WHEREAS, on February 13, 2001, City Council authorized the City Manager to execute a contract with Gray Bowen and Company Inc.; and

WHEREAS, on July 23, 2002, City Council authorized the City Manager to award a professional services contract to Gray Bowen and Company, Inc. for regional transportation related assistance including the Route 4 transfer and relinquishment process, Vasco Road safety and strategic planning.

WHEREAS, on June 22, 2004, City Council authorized the City Manager to execute a contract term amendment extending the termination date from July 23, 2004 to June 30, 2006.

WHEREAS, Gray Bowen and Company, Inc. has provided the City with regional transportation assistance for several years; and

WHEREAS, the City is moving forward with numerous traffic related issues that require skilled professional individuals to guide the City through the more difficult processes; and

WHEREAS, the safety and coordination issues continue to develop between the City of Brentwood and Alameda County; and

WHEREAS, staff has determined that the benefit to utilize this consultant, which specializes in difficult transportation issues, is advantageous to the City.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the City Manager to execute a change order with Gray Bowen and Company, Inc. not to exceed $40,000 for a total contract amount of $105,000.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 9th day of November 2004 by the following vote:

AMENDMENT TWO
TO
AGREEMENT FOR PROFESSIONAL SERVICES
OF GRAY BOWEN & COMPANY, INC.

This Amendment is entered into on November 9, 2004 by and between the City of Brentwood and Gray Bowen & Company, Inc.

WHEREAS, on July 23, 2002, the City of Brentwood entered into a contract to obtain transportation related assistance, including the State Route 4 Transfer and Relinquishment process, the Vasco Road Safety project and Strategic Planning.

WHEREAS, on June 22, 2004, the contract was amended to change the termination date of the contract from July 23, 2004 to June 30, 2006.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 5, of the original contract, entitled Payment is amended to change the not- to-exceed payment limit from a total of $65,000 to a total of $105,000.
2. All future work for the State Route 4 transfer and relinquishment, will be covered under a separate contract.
3. All other terms remain unchanged.
