Subject/Title: Approve a Resolution to include the 400 Guthrie Lane Project within the 2004/05 - 2008/09 CIP Program and authorize the City Manager to execute two Professional Services Agreements for this project.

RECOMMENDATION
Approve a Resolution to include the 400 Guthrie Lane project into the 2004/2005 – 2008/2009 Capital Improvement Program and authorize the City Manager to execute professional services agreements with Gibson/Salmon Group for architecture services in an amount of $79,335 plus a 10% contingency for a total contract amount of $87,268.50 and with RGM and Associates for construction management services in the amount of $87,300 plus a 10% contingency for a total contract amount of $96,030.

PREVIOUS ACTION
On May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program which included the New Police Station project as part of the program.

BACKGROUND
This property known as 400 Guthrie Lane was acquired as part of the US Print property acquisition for the New Police Station project. In order to bring this building up to commercial property standards, the building and site must be brought up to current building code requirements. The improvements to the site include parking, ADA compliant access, entrance requirements, restroom up grades, lighting upgrades, exiting requirements and acoustical modifications. Staff has begun a due diligence of the site and has determined that as an interim housing solution, this property could also serve as the temporary location of City staff (Administration, Finance and Parks and Recreation) during the construction of the New City Hall project. The improvements would remain and be sold with the building.

Staff has worked with Gibson/Salmon Group and RGM and Associates on numerous, multi-prime projects and they have been involved in the different phases of work required to complete a successful project. The 400 Guthrie Lane Improvements will be constructed as a multi-prime project, which allows staff to better control the work and costs associated with construction and recommends that RGM be retained for construction management services for the project.

FISCAL IMPACT
Funding for this work will derive from the General fund and be reimbursed when the property is sold. Costs associated with both professional services agreements are included within the attached CIP budget sheet.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO AUTHORIZE THE INCLUSION OF THE 400 GUTHRIE LANE PROJECT WITHIN THE 2004/2009 CIP PROGRAM AND AUTHORIZE THE CITY MANAGER TO EXECUTE PROFESSIONAL SERVICES AGREEMENTS WITH GIBSON/SALMON GROUP FOR ARCHITECTURE SERVICES IN AN AMOUNT OF $79,335 PLUS A 10% CONTINGENCY FOR A TOTAL CONTRACT AMOUNT OF $87,268.50 AND WITH RGM AND ASSOCIATES FOR CONSTRUCTION MANAGEMENT SERVICES IN THE AMOUNT OF $87,300 PLUS A 10% CONTINGENCY FOR A TOTAL CONTRACT AMOUNT OF $96,030.

WHEREAS, on July 8, 2003, City Council directed staff to begin a due diligence for a possible site relocation to 9100 Brentwood Boulevard for the New Police Station Project; and

WHEREAS, on September 17, 2003, City Council authorized the City Manager to execute a purchase agreement for a note and deed of trust secured by property located at 9100 Brentwood Boulevard; and

WHEREAS, the project before you this evening is located on a portion of the site purchased by the City of Brentwood and is known as 400 Guthrie Lane; and

WHEREAS, building and site improvements will upgrade the property from industrial to commercial property use; and

WHEREAS, staff recommends utilizing the professional services of Gibson/Salmon Group and RGM and Associates in order to complete the design and construction of this project; and

WHEREAS, this approval hereby funds the project and amends the 2004/2005 general fund budget.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, to include the CIP Budget Sheet for the 400 Guthrie Lane Improvements into the CIP Program and that the City Manager is authorized to execute a professional services agreements with Gibson/Salmon Group in an amount not to exceed $79,335.00 plus a 10 % contingency and RGM and Associates in an amount not to exceed $87,300.00 plus a 10% contingency for the 400 Guthrie Lane Improvements Project.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 12th day of October 2004 by the following vote:
