Subject/Title: Approve a Resolution to include the 118 Oak Street Building Improvements into the 2004/05 – 2008/09 CIP Program and authorize the City Manager to execute two Professional Services Agreements for this project.

RECOMMENDATION
Approve a Resolution to include 118 Oak Street Building Improvements into the 2004/05 – 2008/09 Capital Improvement Program, and authorize the City Manager to execute professional services agreements with Gibson/Salmon Group in an amount of $44,885, plus a 10% contingency for a total contract amount of $49,373.50 for the design and with RGM and Associates in the amount of $75,575.00 plus a 10% contingency for a total contract amount of $83,132.50 for construction management services for the 118 Oak Street Building Improvements.

BACKGROUND
City staff received notification from the County Department of Health that they plan to vacate their current location in January 2005. The County Health office is located at 118 Oak Street and is leased from the City of Brentwood. Upon notification, staff began to develop a plan to utilize this unique downtown property in part as a Community Facility. The Community Facility would include a Park and Recreation counter for class and activity signups, a 440 square foot classroom equipped as a computer lab and a large classroom of 600 square feet that is comparable to the existing “blue room.” The remaining space would be shared by the Park and Recreation Department and the recently merged Community Development Department. Connecting doors would be constructed to allow staff to travel between the offices including the Engineering offices. This passage will allow a “connector” between the departments.

Staff has worked with Gibson/Salmon Group and RGM and Associates on numerous, multi-prime projects. The 118 Oak Street Building Improvements will be constructed as a multi-prime project, which allows staff to better control the work and costs associated with construction and recommends that RGM be retained for construction management services for this project.

FISCAL IMPACT
Funding will derive from Impact Fees and is included within the attached CIP program budget sheet. Costs associated with both professional service agreements are also included within the attached budget sheet.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO AUTHORIZE THE INCLUSION OF THE 118 OAK STREET BUILDING IMPROVEMENTS PROJECT WITHIN THE 2004/2009 CIP PROGRAM AND AUTHORIZE THE CITY MANAGER TO EXECUTE PROFESSIONAL SERVICES AGREEMENTS WITH GIBSON/SALMON GROUP FOR ARCHITECTURE SERVICES IN AN AMOUNT OF $44,885 PLUS A 10% CONTINGENCY FOR A TOTAL CONTRACT AMOUNT OF $49,373.50 AND WITH RGM AND ASSOCIATES FOR CONSTRUCTION MANAGEMENT SERVICES IN THE AMOUNT OF $75,575 PLUS A 10% CONTINGENCY FOR A TOTAL CONTRACT AMOUNT OF $83,132.50.

WHEREAS, City staff received notification from the County Department of Health that they plan to vacate their current location of 118 Oak Street leased from the City of Brentwood in January 2005; and

WHEREAS, staff began to develop a plan to utilize this unique downtown property in part as a Community Facility; and

WHEREAS, utilization of this downtown facility will continue to provide the residents a class and activity sign up location in the downtown area; and

WHEREAS, staff recommends utilizing the professional services of Gibson/Salmon Group and RGM and Associates in order to complete the design and construction of this project; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, to include the CIP Budget Sheet for the 118 Oak Street Building Improvements into the CIP Program and that the City Manager is authorized to execute a professional services agreements with Gibson/Salmon Group in an amount not to exceed $44,885 plus a 10% contingency and RGM and Associates in an amount not to exceed $75,575 plus a 10% contingency for the 118 Oak Street Building Improvements Project.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 12th day of October 2004 by the following vote:
