Approve a resolution authorizing the City Manager to execute an agreement
with Signature at Cedarwood, LLC for the maintenance of a temporary sanitary
sewer lift station to serve Cedarwood, Subdivision No. 8534, located north
of Sycamore Avenue and east of Brentwood Boulevard.
On July 1, 2003, by Planning Commission Resolution 03-46, the City approved
Vesting Tentative Subdivision Map No. 8534, for the development of 177 lots
located north of Sycamore Avenue and east of Brentwood Boulevard.
On June 22, 2004, City Council was notified by an Informational Report, of
the approval of Final Subdivision Map No. 8534, creating the first 75 lots
of the Tentative Subdivision Map.
Per the City’s Master Sewer Plan for the east side of town, Signature
Properties, Cedarwood Subdivision, located north of Sycamore Avenue and east
of Brentwood Boulevard, should sewer northerly, across the Stolich-Brown
property, towards Sunset Road and the Wastewater Treatment Plant. As an
interim solution, the developer has proposed to install a temporary sewer
lift station to pump the sewer south to existing lines in Sycamore Avenue.
Upon development of the Stolich parcel to the north of the Cedarwood project
and construction of the ultimate sewer lines to Sunset Road, this temporary
lift station would no longer be necessary and be removed by Signature
There will be no fiscal impact to the City. Signature Properties will
deposit with the City, funds to cover all costs for three years of City
maintenance of the lift station while in operation and a cash bond
equivalent to seven additional years of maintenance should the Stolich
parcel not develop as currently anticipated. Signature Properties will also
deposit a cash bond to ensure connection to the northerly sewer lines and
removal of the lift station.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE
CITY MANAGER TO EXECUTE AN AGREEMENT WITH SIGNATURE AT CEDARWOOD, LLC FOR
THE MAINTENANCE OF A TEMPORARY SANITARY SEWER LIFT STATION TO SERVE
CEDARWOOD, SUBDIVISION NO. 8534, LOCATED NORTH OF SYCAMORE AVENUE AND EAST
OF BRENTWOOD BOULEVARD.
WHEREAS, the City of
Brentwood’s Sewer Master Plan designates sewer design and improvements to
serve new and existing development; and
WHEREAS, per Municipal Code §13.04.085 new development is required to
connect to the City’s Sewer System; and
WHEREAS, ultimate sanitary sewer improvements are not yet constructed to
serve the east side of Brentwood; and
WHEREAS, Signature Properties has designed and will construct sanitary sewer
improvements, including a temporary lift station, to serve their “Cedarwood”
project until such time as ultimate improvements are constructed.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Brentwood authorizes the City Manager to execute an agreement
with Signature at Cedarwood, LLC for the maintenance of the temporary
sanitary sewer lift station to serve the Cedarwood Subdivision No. 8534.
BE IT FURTHER RESOLVED that the City Manager is
authorized to accept funds from Signature at Cedarwood, LLC for maintenance
costs incurred by the City.
AND ADOPTED by the City Council of the City of Brentwood at a regular
meeting on the 12th day of October 2004 by the following vote:
