Subject/Title: Approve a Resolution accepting Improvements for Ryder Homes,
Subdivision No. 8200.

Approve a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the Final Map; accepting all public improvements for
maintenance; accepting the Subdivision Maintenance Bond and releasing the
Subdivision Improvement Securities for Ryder Homes, Subdivision No. 8200,
located west of Walnut Boulevard and north of Continente Avenue.
On November 4, 1998, by Resolution No. 98-55, Planning Commission approved
Tentative Subdivision Map No. 8200, with conditions.
On November 9, 1999, by Resolution No. 99-231, City Council approved Final
Map Subdivision No. 8200, accepting the improvement securities and approving
the Subdivision Improvement Agreement.
This subdivision, located west of Walnut Boulevard and north of Continente
Avenue, has been developed by Ryder Homes and contains 69 single-family
residential lots. All public improvements required by the conditions of
approval for this subdivision have been constructed and inspected for
conformance with the approved improvement plans. These improvements included
Walnut Boulevard and Continente Avenue in front of the project; sewer, water
and storm drain lines, sidewalk, paving, streetlights and fiber optics for
the subdivision. Ryder Homes has provided a Maintenance Bond to cover the
twelve-month warranty period for the improvements.
As required by the conditions of approval and shown on the improvement
plans, the Developer has installed the following improvement quantities:
2,200 LF of 8” sewer lines, 2,500 LF of 8” waterlines, 203 LF of 12” storm
drain lines, 730 LF of 18” storm drain lines, 266 LF of 24” storm drain
lines, 700 LL of 30” storm drain lines, 5,950 LF of curb and gutter, 4,284
LF of 5’ wide sidewalk, 2,689 LF of pavement and 11 streetlights.
When the Final Map was approved by City Council, the right-of-way offers of
dedication were accepted subject to acceptance of improvements. The
improvements are now installed to support the new lots; therefore, it is the
appropriate time to accept the improvements, rights-of-way and easements as
offered on the Final Map.
Upon acceptance of improvements, the City will incur annual costs in the
amount of approximately $13,950 associated with necessary maintenance of
streets, landscaping and utilities. Routine roadway maintenance will be
funded by the General Fund and Measure “C” gas tax, with sewer and water
maintenance funded through their respective enterprise funds. Landscaping
and Lighting Assessment District (LLD) No. 00-3 has been formed for this
subdivision and will be responsible for the street lighting and landscape

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE
RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S
RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP;
ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION
MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR
RYDER HOMES, SUBDIVISION NO. 8200, LOCATED WEST OF WALNUT BOULEVARD AND
NORTH OF CONTINENTE AVENUE.
WHEREAS, on November 4, 1998, by Resolution No. 98-55, Planning Commission
approved Tentative Subdivision Map No. 8200, with conditions; and
WHEREAS, on November 9, 1999, by Resolution No. 99-231, City Council
approved Final Map Subdivision No. 8200, accepting the improvement
securities and approving the Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and
constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
that the public improvements are accepted for maintenance and all offers of
dedication for rights-of-way, easements and parcels of land intended for
public use as shown on the Final Map are hereby accepted.
BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against
defects in material and workmanship for a period of twelve months are hereby
BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds
will be released within sixty (60) days of the passage of this Resolution.
BE IT FURTHER RESOLVED that the City Council of the City of Brentwood
directs the City Clerk to file this Resolution with the Recorder of Contra
