Subject/Title: Approve a Resolution accepting Improvements for Birchwood Estates, Lafferty Homes, Subdivision No. 8048.

RECOMMENDATION
Approve a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all on and off-site public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Birchwood Estates, Lafferty Homes, Subdivision No. 8048, located north of Chestnut Street and west of Garin Parkway.

PREVIOUS ACTION
On April 1, 1997, by Resolution No. 97-16, Planning Commission approved Tentative Subdivision Map No. 8048, with conditions.

On July 28, 1998, by Resolution No. 98-136, City Council approved Final Map Subdivision No. 8048, accepting the improvement securities and approving the Subdivision Improvement Agreement.

BACKGROUND
This subdivision, located north of Chestnut Street and west of Garin Parkway, contains 51 single-family residential lots. All public improvements required by the conditions of approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. Lafferty Homes has provided Maintenance Bonds to cover the twelve-month warranty period for the improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 1,893 LF of 8” sewer lines, 3,304 LF of 12” sewer lines 1,805 LF of 8” waterlines, 963 LF of 18” storm drain lines, 357 LF of 21” storm drain lines, 39 LF of 24” storm drain lines, 3,710 LF of curb and gutter, 3,708 LF of 5’ wide sidewalk, 4,445 LF of pavement and 17 streetlights.

When the Final Map was approved by City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $19,000 associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 98-4 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BONDS AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR BIRCHWOOD ESTATES, LAFFERTY HOMES, SUBDIVISION NO. 8048, LOCATED NORTH OF CHESTNUT STREET AND WEST OF GARIN PARKWAY.

WHEREAS, on April 1, 1997, by Resolution No. 97-16, Planning Commission approved Tentative Subdivision Map No. 8048, with conditions; and

WHEREAS, on July 28, 1998, by Resolution No. 98-136, City Council approved Final Map Subdivision No. 8048, accepting the improvement securities and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements for maintenance and all offers of dedication for rights-of-way, easements and parcels of land intended for public use as shown on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
