Approve a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the final map; accepting all on and off-site public
improvements for maintenance; accepting Subdivision Maintenance Bonds and
releasing the Subdivision Improvement Securities for Hearthstone, Morrison
Homes, Subdivision No. 7950, located south of Sand Creek Road and west of
On July 7, 1998 by Resolution No. 98-22, Planning Commission approved
Tentative Subdivision Map 7950, with conditions.
On October 10, 2000 by Resolution No. 2169, City Council approved Final
Subdivision Map No. 7950, accepting improvement securities and approving a
Subdivision Improvement Agreement.
The Final Map is located south of Sand Creek Road and west of Fairview
Avenue, and was recorded on October 24, 2000, in Book 425 of Maps, at Page
50, Contra Costa County Records. The Subdivision contains 82 single-family
residential lots. All the public improvements as required by the conditions
of approval for this subdivision have been constructed and inspected by the
City inspector. In conjunction with the Final Map, the Developer has
provided improvement securities (Performance and Payment Bonds) for these
improvements. A final inspection of these improvements found them to be
complete and in conformance with the approved improvement plans.
Following are the major improvement quantities installed: 3,427 LF of 8”
sanitary sewer lines, 2,076 LF of 8” waterlines, 1,365 LF of 12” waterlines,
894 LF of 18” storm drain lines, 3,400 LF of sidewalk, 3,400 LF of curb and
gutter, 34,000 SF of pavement and 22 streetlights.
The parcels were offered for dedication on the Final Map. When the Final Map
was approved by City Council, the offers of dedication were accepted subject
to acceptance of improvements. Now that the said parcels are improved, the
City must accept the improvements in order to obtain rights to the parcels
offered on the Final Map. The Developer of Subdivision No. 7950, Morrison
Homes, has already provided a Maintenance Bond (Bond No. 400SZ3431 in the
amount of $231,984) to cover the twelve-month warranty period for the
After the acceptance of improvements, the City will then incur annual costs
in the amount of approximately $13,000 for on-site improvements associated
with street sweeping and necessary repairs to streets and utilities. Regular
roadway maintenance will be funded by the General Fund, Measure “C”, gas tax
and sewer and water maintenance will be funded through respective enterprise
funds. The Lighting and Assessment Maintenance District (LLD No. 95-7) has
been formed for this subdivision and will be responsible for the street
lighting and landscape maintenance.

RESOLUTION ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING

SUBDIVISION NO. 7950, LOCATED SOUTH OF SAND CREEK ROAD AND WEST OF FAIRVIEW
WHEREAS, on July 7, 1998, Planning Commission of the City of Brentwood
approved Resolution No. 98-22, approving the Tentative Map of Subdivision
No. 7950, with conditions; and
WHEREAS, on October 10, 2000, City Council approved Resolution No. 2169,
approving the Final Map of 82 lots in Subdivision No. 7950, with improvement
securities and a Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and are in
conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
that the public improvements are hereby accepted for maintenance, and all
offers of dedication for rights-of-way, easements, and parcels of land
intended for public use as offered on the Final Map are hereby accepted.
BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against
defects in material and workmanship for a period of twelve months is hereby

will be released within sixty (60) days of the passage of this Resolution.
BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby
directs the City Clerk to file this Resolution with the Recorder of Contra
