Meeting Date: August 10, 2004

Subject/Title: Approve a Resolution accepting Improvements for Lyon Rhapsody, William Lyon Homes, Subdivision No. 6665.

Prepared by: Engineering: D. Galey

Submitted by: Engineering: B. Grewal

RECOMMENDATION
Approve a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; and accepting all on and off-site public improvements for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Lyon Rhapsody, William Lyon Homes, Subdivision No. 6665, located east of Brentwood Boulevard and south of Sand Creek Road.

PREVIOUS ACTION
On March 3, 1987, by Resolution No. 87-10, Planning Commission approved Tentative Subdivision Map No. 6665, with conditions.

On January 9, 2001, by Resolution No. 2215, City Council approved Final Map Subdivision No. 6665, accepting the improvement securities and approving the Subdivision Improvement Agreement.

BACKGROUND
This subdivision, located east of Brentwood Boulevard, south of Sand Creek Road and north of Village Drive, contains 81 single-family residential lots. All public improvements required by the conditions of approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. William Lyon Homes has provided Maintenance Bonds to cover the twelve-month warranty period for the improvements.

Following are the major improvement quantities installed: 1,185 LF of 8” sanitary sewer lines, 950 LF of 10” sanitary sewer, 2,600 LF of 10” off-site sanitary sewer, 2,310 LF of 8” waterlines, 390 LF of 18” storm drain lines, 770 LF of 24” storm drain lines, 365 LF of 30” storm drain lines, 400 LF of 48” storm drain lines, 520 LF of 36” off-site storm drain lines, 2,250 LF of curb and gutter, 2,250 LF of 5’ wide sidewalk, 40,500 SF of pavement and 16 streetlights.

When the Final Map was approved by City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $15,000 associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the general fund, Measure “C”, gas tax and sewer and water maintenance funded through their respective enterprise funds. Lighting and Lighting Assessment District (LLD No. 00-2) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.
