Subject/Title: Approve a Resolution authorizing the City Manager to execute a contract amendment approving additional funds for B&B International related to the physical plant inspection of the cable television system in the amount of $30,000

RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a contract amendment to add $30,000 to an existing contract with B&B International in order to complete an additional physical plant inspection of the cable television system.

PREVIOUS ACTION
In September, 2003, the City contracted with B&B International to provide inspection services of the broadband cable system for the City in the amount of $50,000.

BACKGROUND
After the initial study, staff believes that the initial work needs additional inspection of the physical plant to provide a better analysis of the rebuilt physical plant of the City’s cable television system. The additional $30,000 should complete the further testing of the broadband cable television system recently rebuilt by Comcast.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN ADDITIONAL $30,000 TO THE EXISTING CONTRACT WITH B&B INTERNATIONAL FOR FURTHER PHYSICAL PLANT TESTING OF THE CABLE TELEVISION SYSTEM

WHEREAS, the City Council previously authorized on or about September 4, 2003, the hiring of B&B International to assist the City with the inspection/testing of the physical plant of the City’s cable television system recently rebuilt by Comcast; and

WHEREAS, B&B International specializes in physical plant inspection of cable television systems; and

WHEREAS, the City requires additional physical plant inspection of the recently rebuilt cable television system; and

WHEREAS, the City has an existing contract to complete the testing/inspection services of the City’s cable television system with B &B International.

NOW, THEREFORE BE IT RESOLVED that the City Council authorizes an additional $30,000 to an existing agreement with B&B International to complete further testing/inspection of the City’s cable television system.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 10th day of August, 2004 by the following vote:

AMENDMENT NO. 1
TO
AGREEMENT FOR PROFESSIONAL CONSULTANT SERVICES

THIS AMENDMENT NO. 1 is entered into on August 10, 2004 by and between the CITY OF BRENTWOOD (“City”) and B&B INTERNATIONAL (“Consultant”).

WHEREAS, on September 4, 2003, the City and Consultant executed an Agreement for Professional Consultant Services with B&B International to provide inspection/testing of the physical plant of the City’s cable television system; and

WHEREAS, the City needs additional services to revise the cable franchise ordinance and assistance with further inspection/testing of the physical plant of the cable television system; and

WHEREAS, staff is recommending that the City Council authorize an additional $30,000 to an exiting contract with B&B International in order to continue the inspection/testing of the cable television system within the City of Brentwood.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 4 of the original agreement, entitled Term, is amended to change the date of termination of the agreement to December 31, 2004;

2. Section 5 of the original agreement, entitled Payment, is changed to an amount not to exceed $80,000, or an additional $30,000; and

3. All other terms of the original agreement shall remain unchanged.
