Subject/Title: Approve a Resolution Approving the Contract Documents and Award the Construction Contract for the O’Hara Loop Realignment, CIP Project No. 336-3145 and Amend the CIP Budget Sheet.

RECOMMENDATION
Approve a Resolution approving the contract documents and award the construction contract for
The O’Hara Loop Realignment, CIP Project No. 336-3145, to Bay Cities Paving & Grading, Inc. and authorize the City Manager to execute the agreement and necessary documents in the amount of $1,524,296.32, plus the authority to execute change orders up to 10% of the contract amount and amend the CIP Budget Sheet to reflect increased industry construction costs.

PREVIOUS ACTION
On May 27, 2003, City Council approved Resolution No. 2868, approving the 2003/04 - 2007/08 Capital Improvement Program (CIP) for the City of Brentwood, which included the O’Hara Loop Realignment, CIP Project No. 336-3145.

On June 10, 2003, by Resolution No. RA-69, the Redevelopment Agency adopted its 2003-2005 Budget, which included $1,000,000 for the O’Hara Loop Realignment project.

On September 23, 2003, City Council approved Resolution No. 2983, approving the Professional Consultant Services Agreement with Northstar Engineering Group, Inc. for the design of O’Hara Loop Realignment, CIP Project No. 336-3145.

On July 13, 2004, City Council approved Resolution No. 2004-167, certifying the mitigated Negative Declaration for the O’Hara Loop Realignment, CIP Project No. 336-3145 and authorizing staff to move forward with the project.

BACKGROUND
The completion of Sand Creek Road from the Hwy 4 Bypass to Brentwood Boulevard has brought additional traffic destined for downtown onto O’Hara Avenue south of Sand Creek Road. To accommodate additional traffic and to improve circulation into the downtown area, it becomes imperative to complete the missing direct link from O’Hara Avenue to Second Street at Central Boulevard. This project will improve traffic circulation from the central and northwest areas of Brentwood, to downtown and to Liberty High School.

The City of Brentwood advertised the project for construction beginning Thursday, July 15, 2004 and bids were opened on Tuesday, August 3, 2004. A total of three bids were received, the bids were reviewed and the lowest responsive, responsible bid was received from Bay Cities Paving & Grading, Inc.

The three bids were:

1. Bay Cities Paving & Grading, Inc. $1,524,296.32
2. De Silva Gates Construction $1,581,100.00
3. Grade Tech, Inc. $1,748,135.00

Staff recommends the award of the construction contract for the O’Hara Loop Realignment, CIP Project No. 336-3145 to Bay Cities Paving & Grading, Inc. for the amount of $1,524,296.32 plus 10% contingencies for a total contract amount of 1,676,725.95.

Since the low bid was higher than the construction budget, the CIP Budget Sheet must be amended to reflect this appropriate 15% increase. Unfortunately, the construction industry has recently seen increases from 5% to 25% due to higher material costs for steel, cement, concrete, asphalt, copper, etc., causing a higher low bid amount then expected (exceeds Engineer’s estimate by 15%). Therefore, after review of the low bid, it appears that the unit price items are at a reasonable cost, considering the recent trend in higher costs for materials.

FISCAL IMPACT
The funds associated with this work are included in the recently adopted Capital Improvement Program 2004/2009 and the budget contains funds for the construction of the O’Hara Loop Realignment, CIP Project No. 336-3145, in the amount of $1,316,374 and with the apparent low bid of $1,524,296.32, being above the construction budget, the project budget for construction and project administration must be amended.

The amended budget listed below now includes the low bid amount from Bay Cities Paving & Grading, Inc., including contingency, construction inspection and testing costs.

This project is primarily funded by the Redevelopment Agency ($1,000,000). The remainder will be funded by Roadway Facility Fees and staff has confirmed with the Finance Department that there are sufficient funds to cover the proposed amended budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO APPROVE THE CONTRACT DOCUMENTS AND AWARD THE CONSTRUCTION CONTRACT FOR THE O’HARA LOOP REALIGNMENT, CIP PROJECT NO. 336-3145, TO BAY CITIES PAVING & GRADING, INC. AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE AGREEMENT AND NECESSARY DOCUMENTS IN THE AMOUNT OF $1,524,296.32, PLUS THE AUTHORITY TO EXECUTE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT AND AMEND THE CIP PROJECT BUDGET SHEET.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the contract documents are approved and the award of the construction contract for the O’Hara Loop Realignment, CIP Project No. 336-3145, is awarded to Bay Cities Paving & Grading, Inc., and further authorize the City Manager to execute changes orders within a 10% contingency for a total authorized contract amount of $1,676,725.95.

BE IT FURTHER RESOLVED that the budget sheet for the O’Hara Loop Realignment, CIP Project No. 336-3145 hereby be amended.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 10th day of August 2004 by the following vote:

AGREEMENT

O’HARA LOOP REALIGNMENT
CIP PROJECT NO. 336-3145

THIS AGREEMENT FOR CONSTRUCTION is made and entered into this 10th day of August 2004, by and between the City of Brentwood (herein called City) and Bay Cities Paving & Grading, Inc., a California corporation, a partnership or an individual (circle one) located at 5029 Forni Drive, Concord, CA 94520, herein called Contractor.

The City and the Contractor agree as follows:

(1) CONTRACT SUM: The City agrees to pay, and the Contractor agrees to accept, in full payment for constructing the Project in strict accordance with the Contract Documents and performing all other requirements of the Contract Documents, the sum of One Million Five Hundred Twenty Four Thousand Two Hundred Ninety Six Dollars and Thirty Two Cents ($1,524,296.32) to be paid in accordance with the Contract Documents.

(2) COMPLIANCE WITH LAW: The City is a public agency. All provisions of law applicable to public contracts are a part of this contract to the same extent as though set forth herein and will be complied with by the Contractor.

(3) CONTRACT DOCUMENTS: The following Contract Documents relating to this Agreement are hereby made a part of and incorporated by reference into this Agreement: The Notice Inviting Bids, Invitation to Bid, Information for Bidders, Contract Proposal, Faithful Performance Bond, Labor and Materials Payment Bond, Contractor’s Certificate Regarding Worker’s Compensation, Certificate of Insurance and Endorsement (Worker’s Compensation), Certificate of Insurance and Endorsement (General Liability), General Conditions, Special Provisions, Plans and Specifications, CalTrans Standard Plans and Specifications, City of Brentwood Standard Plans and Specifications, Plans, and supplemental agreements, certifications, and endorsements applicable to this work, with all modifications incorporated in said documents prior to receipt of the Contract Proposals. Any work called for in one Contract Document not mentioned in another is to be performed and executed the same as if mentioned in all Contract Documents.

Contractors are required by law to be licensed and regulated by the Contractor’s State License Board which has jurisdiction to investigate complaints against contractors if a complaint is filed within three years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors’ State License Board, P.O. Box 26000, Sacramento, California 95826.

This Agreement is executed by the City upon approval by the City Council at their regular scheduled meeting of August 10, 2004 and the Contractor has caused this Agreement to be duly executed.
