Subject/Title: Approve a Resolution accepting the work performed by Indio’s Construction, Inc. for the City Park Play Area, CIP Project No. 522-5226.

RECOMMENDATION
Approve a Resolution accepting the work performed by Indio’s Construction, Inc. for the City Park Play Area, CIP Project No. 522-5226, and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
July 10, 2001: City Council approved a resolution authorizing and approving the application for grant funds for the Per Capita Grant Program under the Safe Neighborhood Parks, Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 (Prop 12).

August 14, 2001: City Council approved the application for grant funds for the Roberti-Z’Berg-Harris Urban Open Space and Recreation Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 (Prop 12).

August 28, 2001: City Council authorized an application to apply for grant funding from the California Integrated Waste Management Board for the Park Playground Accessibility and Recycling Grant Program for City Park.

October 23, 2001: City Council authorized an application to apply for grant funding from the California Integrated Waste Management Board for the Waste Tire Playground Cover Grant Program for City Park and approved the recommendation from the Parks and Recreation Commission to use the Proposition 12 State Park Bond Act funds for use at City Park.

March 11, 2003: City Council accepted the initial conceptual design for the redevelopment of City Park, located at Oak and Second Streets, approved the use of Proposition 12 State Park Bond Act funds for the relocation and renovation of the play area as per the conceptual design and authorized the City Manager to enter into agreement with Abey/Arnold, Landscape Architects, to provide construction design services for the play area.

November 25, 2003: City Council approved a Resolution approving the contract documents for the playground portion of the City Park Redesign, CIP Project No. 522-5226, and directing staff to put the playground project out to bid.

January 13, 2004: City Council approved a Resolution awarding contract for the City Park Play Area, CIP Project No.522-5226 to Indio’s Construction, Inc. in the amount of $286,500 and authorized the City Manager to execute the agreement and necessary documents and authorize change orders up to 10% of the contract amount.

BACKGROUND
The City Park Play Area project provided for the relocation and development of an ADA compliant play environment in City Park. The play area improvements include a school age climber, a tot climber, a tot club house, tot swings, a sand play area, resilient safety surfacing made of recycled tires, cool toppers for shade, picnic tables and benches, a drinking fountain, metal trellises and tubular steel fencing, and landscape and irrigation.

The authorized construction contract with Indio’s Construction, Inc. approved a bid amount of $286,500 plus a 10% contingency for a total contract amount of $315,150. The construction of contract work and related contingencies has amounted to $291,490.30 and has stayed within the original 10% contingency.

The contractor, Indio’s Construction, Inc. has completed all contract work and has met all contractual requirements. Staff recommends City Council acceptance of this contract work. This action will allow the City Clerk to file the Notice of Completion and allow staff to close out this CIP project.

FISCAL IMPACT
Construction funding for the City Park Area is budgeted in the adopted 2003/04-2007/08 Capital Improvement Program, City Park Redesign, CIP Project No. 522-5226. The construction line item budget for fiscal 03-04 totals $333,484.00, funded through State Funding/Grants. Of this $333,484.00, California Integrated Waste Management Board grants are providing $75,000.00 and Proposition 12 per capita block grants are funding $258,484.00.

Final grant reports were submitted to the California Integrated Waste Management Board, by the City’s Grants Administrator, and the City has received the $75,000 reimbursement from this funding source.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO ACCEPT THE WORK PERFORMED BY INDIO’S CONSTRUCTION, INC. FOR THE CITY PARK PLAY AREA, CIP PROJECT NO. 522-5226 AND DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, on January 13, 2004, City Council approved a Resolution awarding contract for the City Park Play Area, CIP Project No.522-5226 to Indio’s Construction, Inc. in the amount of $286,500 and authorized the City Manager to execute the agreement and necessary documents and authorize change orders up to 10% of the contract amount; and

WHEREAS, the contractor, Indio’s Construction, Inc. has completed all contract work and has met all contractual requirements: and

WHEREAS, the total project cost falls within the approved 2003/04-2007/08 Capital Improvement Program construction line item budget for City Park Redesign, CIP No. 522-5226;

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the City Park Play Area, CIP Project No. 522-5226, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for this project.
