Reject the claim of Ruben Pina presented on May 3, 2004 as recommended by
the City’s third party adjuster, Contra Costa County Municipal Risk
Management Insurance Authority, City of Brentwood Public Works Department
and the City Attorney.
Claimant, Ruben Pina, presented a claim in the amount of $300.00. Claimant
states that on April 11, 2004 his toilet overflowed and ruined his carpet,
and his ceiling needs to be replaced. He further states that the toilet
overflowed due to damage and or leakage in the main water sewage line. He
alleged that there has been a water leak since he moved into the property.
He further claims that there was a prior incident of toilet overflow caused
by the City and thus, the City should pay for the excessive water bill.
The claimant leases the subject property, and the landlord wrote a letter
about the incident. The upstairs master bedroom toilet clogged allowing
water to run continuously. The landlord replaced all toilet float valves and
then checked the water meter. He confirms that the water was no longer
running. The landlord solved the problem with float valves.
