RECOMMENDATION
Approve a Resolution certifying the mitigated Negative Declaration for the O’Hara Loop Realignment, CIP Project No. 336-3145 and authorize staff to move forward with the project.

PREVIOUS ACTION
On May 27, 2003, City Council approved Resolution No. 2868, approving the 2003/04 - 2007/08 Capital Improvement Program (CIP) for the City of Brentwood, which included the O’Hara Loop Realignment, CIP Project No. 336-3145.

On June 10, 2003, by Resolution No. RA-69, the Redevelopment Agency adopted its 2003-2005 Budget, which included $1,000,000 for the O’Hara Loop Realignment project.

On September 23, 2003, City Council approved Resolution No. 2983, approving the Professional Consultant Services Agreement with Northstar Engineering Group, Inc. for the design of O’Hara Loop Realignment, CIP Project No. 336-3145.

BACKGROUND
The completion of Sand Creek Road from the Hwy 4 Bypass to Brentwood Boulevard has brought additional traffic destined for downtown onto O’Hara Avenue south of Sand Creek Road. To accommodate additional traffic and to improve circulation into the downtown area, it becomes imperative to complete the missing direct link from O’Hara Avenue to Second Street at Central Boulevard. This project will improve traffic circulation from the central and northwest areas of Brentwood, to downtown and to Liberty High School.

The City’s environmental consultant for this project, Raney Planning and Management (RPM), has prepared a mitigated Negative Declaration in accordance with the provisions of the California Environmental Quality Act (CEQA). CEQA requires state and local government agencies to consider the environmental consequences of proposed projects. The intent of the subject mitigated Negative Declaration is to provide information concerning any potential environmental effects of the proposed project and to indicate possible ways to reduce or avoid potential significant effects. It is not the purpose of the mitigated Negative Declaration to either recommend approval or denial of the proposed project.

RPM has investigated and analyzed the environmental impacts of this project and identified appropriate mitigation measures, which are addressed in the mitigated Negative Declaration. Comments have been solicited from the public and affected regulatory agencies as well as submitting copies to the State Clearinghouse. All relevant comments and responses have been incorporated into the Final Mitigated Negative Declaration document. No significant areas of controversy or unresolved issues have arisen since the solicitation of the public comments. All impacts were found to be mitigable to levels of insignificance. A mitigation monitoring program has been developed and incorporated into the mitigated Negative Declaration to ensure that the appropriate mitigation measures are properly administered and will be incorporated into the construction documents as well.

The following categories of environmental effects and recommended mitigation measures were considered in the mitigated Negative Declaration:

• Land Use
• Biological Resources
• Transportation and Circulation
• Air Quality
• Hydrology and Water Quality
• Utilities and Safety
• Noise and Vibration

FISCAL IMPACT
There is no direct fiscal impact associated with approval of the mitigated Negative Declaration. Any costs associated with the appropriate mitigation measures have been accounted for in the project budget and will be implemented during the appropriate phase of the project.

Negative Declaration

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO CERTIFY THE MITIGATED NEGATIVE DECLARATION FOR THE O’HARA LOOP REALIGNMENT, CIP PROJECT NO. 336-3145 AND AUTHORIZE STAFF TO MOVE FORWARD WITH THE PROJECT.

WHEREAS, on May 27, 2003, City Council approved Resolution No. 2868, approving the 2003/04 - 2007/08 Capital Improvement Program (CIP) for the City of Brentwood, which included the O’Hara Loop Realignment, CIP Project No. 336-3145; and

WHEREAS, on June 10, 2003, by Resolution No. RA-69, the Redevelopment Agency adopted its 2003-2005 Budget, which included $1,000,000 for the O’Hara Loop Realignment project; and

WHEREAS, on September 23, 2003, City Council approved Resolution No. 2983, approving the Professional Consultant Services Agreement with Northstar Engineering Group, Inc. for the design of O’Hara Loop Realignment, CIP Project No. 336-3145; and

WHEREAS, this project will extend the roadway at Second Street from Central Avenue to O’Hara Avenue; and

WHEREAS, due to the need for smooth traffic flow and improved circulation directly into the downtown area, it is now imperative that staff continue to move forward with this project; and

WHEREAS, this project will provide superior access from north and west portions of the City to the downtown area, and will improve transportation infrastructure and vehicular circulation patterns throughout the merged redevelopment project areas, and to promote business retention and attraction in the downtown area; and

WHEREAS, the intent of the subject mitigated Negative Declaration is to provide information concerning any potential environmental effects of the proposed project and to indicate possible ways to reduce or avoid potential significant effects; and

WHEREAS, no significant areas of controversy or unresolved issues have arisen since the solicitation of the public comments. All impacts were found to be mitigable to levels of insignificance.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby certify the mitigated Negative Declaration for the O’Hara Loop Realignment, CIP Project No. 336-3145 and authorize staff to move forward with the project.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 13th day of July 2004 by the following vote:
