RECOMMENDATION
Approve a Resolution approving a purchase agreement with Mary Silva and Adeline Becerra, for real property identified as 140 Jane Street, (formerly Sunset Road), Brentwood, CA, APN 016-010-013-7, accepting real property on behalf of the Redevelopment Agency and authorizing the Redevelopment Agency’s Executive Director and Agency Secretary or any of their designees to execute the agreement, and such other documents as may be needed to complete the transaction including acceptance of the Deed.

PREVIOUS ACTION
On June 8, 2004, the Redevelopment Agency provided direction to the City’s negotiators, John Stevenson and Howard Sword, regarding land acquisition.

BACKGROUND
The property located at 140 Jane Street suffers from deteriorated buildings, defective or substandard building design, lack of City water services, and has multiple building code violations. 140 Jane Street is currently zoned PD-23. The permitted use in PD-23 is R-1, single family residential.

The property owners initiated the sale by offering it for sale to the Redevelopment Agency. Since this is an owner-initiated sale and not a forced sale, no relocation benefits are triggered. The purchase price is $360,000 with no contingencies except that the close of escrow will occur five days after tenant vacancy. Tenants were given a 60-day notice to vacate on May 27, 2004. Purchase of this property by the Agency is the catalyst for future redevelopment of the area.

Due to the significant deterioration of the buildings, as disclosed by sellers, all buildings are recommended by staff for immediate demolition for safety and liability purposes.

FISCAL IMPACT
The acquisition costs will be funded by the Housing Fund 302.

RESOLUTION NO.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD APPROVING AN AGREEMENT FOR PURCHASE OF A FEE PARCEL WITH MARY SILVA AND ADELINE BECERRA, AS JOINT TENANTS, FOR REAL PROPERTY IDENTIFIED AS 140 JANE STREET, BRENTWOOD, CA, APN 016-010-013-7, ACCEPTING REAL PROPERTY ON BEHALF OF THE AGENCY, AND AUTHORIZING THE REDEVELOPMENT AGENCY’S EXECUTIVE DIRECTOR AND AGENCY SECRETARY OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT, AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED.

WHEREAS, 140 Jane Street (“Property”) is located within the boundaries of the Redevelopment Plan for the North Brentwood Redevelopment Project, and is subject to rights, restrictions, conditions and provisions of said Plan and any amendments thereto; and

WHEREAS, the Property is owned by Mary Silva and Adeline Becerra (“Owners”), as joint tenants, and further identified as APN 016-010-013-7; and

WHEREAS, the Property is blighted with deteriorated and defective buildings, inadequate infrastructure, and excessive building code violations; and

WHEREAS, for future redevelopment opportunities of the Property and possibly the immediate surrounding area, the Agency will acquire the Property with its Low and Moderate Housing Funds to remove said blighted conditions from the premises, and shall demolish the buildings and clear the land for safety and liability purposes during the interim; and

WHEREAS, a Purchase Agreement between the Agency and the Owners has been developed for the necessary transfer of the Property.

NOW, THEREFORE BE IT RESOLVED, by the Redevelopment Agency of the City of Brentwood, that the Agency hereby finds and determines as follows:

1. The Redevelopment Plan for the North Brentwood Redevelopment Project authorizes the acquisition of real property located in the Project Area for future redevelopment purposes.

2. The payment from Low and Moderate Housing Fund will assist in the elimination of one or more blighting conditions inside the Project.

3. The Implementation Plan identifies as goals and objectives the following:

Eliminate conditions of blight existing in the Project Area and insure, to the extent possible, that the causes of blighting conditions will be eliminated or prevented.

Expend tax increment revenues for the express and exclusive purpose of increasing, improving, and preserving a community’s supply of low and moderate-income housing.

4. The Executive Director, City Attorney and Agency Secretary, or their designees, are authorized to execute the Purchase Agreement for the Property for an amount not to exceed $360,000, plus incidental fees and any related escrow fees and to take all actions and execute documents to complete the purchase transaction.

5. The Agency staff is directed to take actions necessary to demolish the existing structures on the Property, and to clear the Property for safety and liability purposes.

BE IT FURTHER RESOLVED, that the Brentwood Redevelopment Agency hereby accepts the real property described in the Grant Deed.

PASSED, APPROVED AND ADOPTED by the Redevelopment Agency of the City of Brentwood at a regular meeting held on the 13th day of July 2004 by the following vote:
