Approve a Resolution accepting the contract documents and awarding the
construction contract for the 2003/2004 Pavement Management Program, CIP
Project No. 336-3083, to Bay Cities Paving & Grading, Inc. and authorizing
the City Manager to execute the agreement and necessary documents in the
amount of $654,259.30, plus the authority to execute change orders up to 10%
of the contract amount.
On May 27, 2003, City Council adopted the 2003/08 CIP budgeting program of
which this project is included.
On April 14, 2004, the City Manager executed a Professional Services
Agreement with Harris & Associates for the design of the 2003/2004 Pavement
Management Program, CIP Project No. 336-3083.
The City ran an advertisement for the Pavement Management Program
construction, beginning Friday, May 7, 2004 and bids were opened on June 10,
2004. A total of four bids were received. The bids were reviewed and the
lowest, responsible bid was received from Bay Cities Paving & Grading, Inc.
The four bids were as follows:
1. Antioch Paving $829,574.48
2. MCK Services, Inc. $736,094.05
3. Granite Construction $690,710.90
4. Bay Cities Paving & Grading, Inc. $654,259.30
Staff recommends the award of the construction contract for the 2003/2004
Pavement Management Program, CIP Project No. 336-3083 to Bay Cities Paving &
Grading, Inc. for the amount of $654,259.30, plus 10% contingencies for a
total contract amount of $719,689.23.
The City conducts a survey of existing roads every three years and after
analyzing the data and receiving input from citizens and staff,
determination is made as to the roads that need immediate and urgent
pavement repairs. The streets included in this year’s program are: Balfour
Road (between Marsh Creek Bridge and Fairview Avenue), Sand Creek Road
(between Brentwood Blvd. and 500’ west of Brentwood Blvd.), Randy Way, Quail
Court, Dove Court and Laurie Drive.
The approved 2004/05 CIP budget funding for the Pavement Management Program
is $1,400,000 which includes design and construction. This project is funded
through Measure “C” and the General Fund. This project will reduce the
maintenance cost for these portions of road for many years to come.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE
CONTRACT DOCUMENTS AND AWARDING THE CONSTRUCTION CONTRACT FOR THE 2003/2004
PAVEMENT MANAGEMENT PROGRAM, CIP PROJECT NO. 336-3083, TO BAY CITIES PAVING
& GRADING, INC. AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT
AND NECESSARY DOCUMENTS IN THE AMOUNT OF $654,259.30, PLUS THE AUTHORITY TO
EXECUTE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT.
WHEREAS, on May 27, 2003, City Council adopted the 2003/08 CIP budgeting
program of which this project is included; and
WHEREAS, On April 14, 2004, the City Manager executed a Professional
Services Agreement with Harris & Associates for the design of the 2003/2004
Pavement Management Program, CIP Project No. 336-3083; and
WHEREAS, the bid opening for said project was held on June 10, 2004 and Bay
Cities Paving & Grading, Inc. was determined to have provided the lowest,
responsible base bid of $654,259.30 for the 2003/2004 Pavement Management
Program, CIP Project No. 336-3083.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood
does hereby accept the contract documents and award the construction
contract for the 2003/2004 Pavement Management Program, CIP Project No.
336-3083, to Bay Cities Paving & Grading, Inc. in the amount of $654,259.30.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute
change orders up to 10% of the contract amount.
PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at
a regular meeting on the 22nd day of June 2004 by the following vote:

THIS AGREEMENT FOR CONSTRUCTION is made and entered into this 22nd day of
June, by and between the City of Brentwood (herein called City) and Bay
Cities Paving & Grading, Inc., a California corporation, a partnership or an
individual (circle one) located at 5029 Forni Drive, Concord, CA 94520,
herein called Contractor.
The City and the Contractor agree as follows:
(1) CONTRACT SUM: The City agrees to pay, and the Contractor agrees to
accept, in full payment for constructing the Project in strict accordance
with the Contract Documents and performing all other requirements of the
Contract Documents, the sum of Six Hundred Fifty Four Thousand Two Hundred
Fifty Nine Dollars and Thirty Cents ($654,259.30) to be paid in accordance
with the Contract Documents.
(2) COMPLIANCE WITH LAW: The City is a public agency. All provisions of law
applicable to public contracts are a part of this contract to the same
extent as though set forth herein and will be complied with by the
(3) CONTRACT DOCUMENTS: The following Contract Documents relating to this
Agreement are hereby made a part of and incorporated by reference into this
Agreement: The Notice Inviting Bids, Invitation to Bid, Information for
Bidders, Contract Proposal, Faithful Performance Bond, Labor and Materials
Payment Bond, Contractor’s Certificate Regarding Worker’s Compensation,
Certificate of Insurance and Endorsement (Worker’s Compensation),
Certificate of Insurance and Endorsement (General Liability), General
Conditions, Special Provisions, Plans and Specifications, CalTrans Standard
Plans and Specifications, City of Brentwood Standard Plans and
Specifications, Plans, and supplemental agreements, certifications, and
endorsements applicable to this work, with all modifications incorporated in
said documents prior to receipt of the Contract Proposals. Any work called
for in one Contract Document not mentioned in another is to be performed and
executed the same as if mentioned in all Contract Documents.
Contractors are required by law to be licensed and regulated by the
Contractor’s State License Board which has jurisdiction to investigate
complaints against contractors if a complaint is filed within three years of
the date of the alleged violation. Any questions concerning a contractor may
be referred to the Registrar, Contractors’ State License Board, P.O. Box
26000, Sacramento, California 95826.
This Agreement is executed by the City upon approval by the City Council at
their regular scheduled meeting of June 22, 2004, and the Contractor has
caused this Agreement to be duly executed.
