Subject/Title: Approve a Resolution for the Acceptance of Improvements for “Brentwood Country Club”, Pulte Home Corporation, Subdivision No. 8089 Phase “A”.

RECOMMENDATION
Approve a Resolution accepting the offers of dedication for easements for ingress and egress for emergency vehicles for Parcels “A” through “P”, Parcel “R”, Parcel ”S” and Parcel “U”; accepting the offers of dedication for areas marked as “Public Service Easement or “P.S.E.” and “Storm Drain Easement” or “S.D.E.” for public use for public services and utility purposes; accepting the offers of dedication in fee for Parcel “Z” and the 10-foot widening of Concord Avenue as dedicated to the City of Brentwood for public use as shown on the Final Map; accepting the subsurface water rights relinquished on said Final Map and accepting public improvements (waterlines, sanitary sewer, storm drain and fiber optics), accepting the Subdivision Maintenance Bonds (Bond No. 6196419-0001 in the amount of $262,843.30) and releasing the Subdivision Performance and Payment Bonds for Subdivision No. 8089 Phase “A”, “Brentwood Country Club” by Pulte Home Corporation, located north of Concord Avenue and east of Fairview Avenue.

PREVIOUS ACTION
On August 15, 2000, Planning Commission approved Resolution No. 00-47, approving Tentative Subdivision Map No. 8089, with conditions.

On June 4, 2002, Planning Commission approved Resolution No. 02-32, approving an Amendment to Vesting Tentative Subdivision Map No. 8089, with conditions.

On February 25, 2003, City Council approved Resolution No. 2802, approving the Subdivision No. 8089 Final Map, accepting the offers of dedication shown thereon subject to acceptance of improvements, except Parcels “V” (Creek Habitat Area) and “W” (Marsh Creek Trail) that were offered in fee to the City of Brentwood and accepted with this Final Map approval. Also at the same meeting, the Developer submitted improvement securities for this project and the Subdivision Improvement Agreement that was approved with the same Final Map.

BACKGROUND
The Final Map, located north of Concord Avenue and east of Fairview Avenue, is part of the Summerset Active Adult Community and was recorded on March 13, 2003, in Book 452 of Maps, at Page 1, Contra Costa County Records. The subdivision contains 249 single-family residential lots for Phase “A” (115 lots) and Phase “B” (134 lots). In conjunction with the Final Map, the Developer provided Performance and Payment Bonds for each phase. The following are the major improvement quantities installed in Subdivision No. 8089 Phase “A”: 4,016 L.F. of 8” sanitary sewer line, 1,529 L.F. of 15” sanitary sewer line, 182 L.F. of 24” sanitary sewer line, 3,761 L.F. of 8” PVC waterline, 2,072 L.F. of 8” DIP waterline, 5,390 L.F. of 18” storm drain line, 248 L.F of 24” storm drain line, 6,382 L.F. of 4’ wide sidewalk, 8,892 L.F. of curb and gutter, 217,878 S.F. of pavement, 78 streetlights, 232 street trees and 5,833 L.F. of joint trench. A final inspection of the street improvements found them to be completed and in conformance with the approved improvement plans.

As a condition of approval for this subdivision, Concord Avenue was widened from Fairview Avenue to Walnut Boulevard. The intersection of Walnut Boulevard and Concord Avenue was widened to provide protected left turn lanes on Walnut Boulevard.

Also, per the conditions of approval, this development was required to build the trail along Creek Road, along the project eastern boundary line and the bridge over the ECCID Main Canal.

Per the schedule submitted from the Developer, the pedestrian bridge over the Main Canal is almost complete and they are anticipating the work to be completed by June 4, 2004. The trail will be paved on June 4, 2004 and the landscaping will be installed by August 1, 2004. So, acceptance of these two items will happen in the future with Subdivision No. 8089 Phase “B”.

Parcels “A” through “P”, Parcel “R”, Parcel “S” and Parcel ”U” are private streets for which an easement for ingress and egress for emergency vehicles were offered for dedication to the City of Brentwood on the Final Map. In addition, areas marked “P.S.E” (Public Service Easement), “S.D.E.” (Storm Drain Easement) were offered for dedication to the City of Brentwood on the Final Map for public use. Also, Parcel “Z” and the 10-foot widening of Concord Avenue were offered in fee to the City of Brentwood on this Final Map for public use. When the Final Map was approved by City Council, the offers of dedication were subject to the acceptance of improvements. Now that the above improvements have been completed, the City must accept these improvements in order to obtain title to the easements and parcels offered on the Final Map. The Developer for Subdivision No. 8089 Phase “A”, Pulte Home Corporation, has also provided Maintenance Bonds (Bond No. 6196419-0001 in the amount of $262,843.30) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of the improvements, the City will then incur costs of approximately $14,700 per year, associated with necessary repairs of utilities. The maintenance for private streets will be done by the Homeowner’s Association. The storm drain maintenance (funded by the General Fund, Measure “C” and gas taxes) will cost approximately $1,353 per year. The sewer and water maintenance (funded through respective enterprise funds) will cost approximately $6,872 per year for sewer maintenance and approximately $6,416 per year for water maintenance. A Lighting and Landscaping Assessment District (LLD No. 94-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL RIGHT-OF-WAY, PARCELS, EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP; ACCEPTING SUBSURFACE MINERAL RIGHTS AND ACCEPTING ALL ON-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8089 PHASE “A”, “BRENTWOOD COUNTRY CLUB”, BY PULTE HOME CORPORATION, LOCATED NORTH OF CONCORD AVENUE AND EAST OF FAIRVIEW AVENUE.

WHEREAS, on August 15, 2000, by Planning Commission Resolution No.00-47, the Planning Commission approved Tentative Subdivision Map No. 8089, with conditions; and

WHEREAS, on June 4, 2002, by Planning Commission Resolution No. 02-32, the Planning Commission approved an Amendment to Vesting Tentative Subdivision Map No. 8089, with conditions; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance, and the offers of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the maintenance for in-tract improvements for Subdivision No. 8089 Phase “A”, to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for parcels “A” through “P”, Parcel “R”, Parcel “S” and Parcel ”U” for ingress and egress for emergency vehicles, all areas marked as “P.S.E.” (Public Service Easement) and “S.D.E.” (Storm Drain Easement) for public use for public services and utility purposes. Also, that the offers of dedication in fee are hereby accepted for Parcel “Z” and 10 feet widening of Concord Avenue for public use and subsurface water rights as shown on the Final Map of Subdivision No. 8089.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
