Subject/Title: Approve a Resolution for the Acceptance of Improvements for “Brentwood Country Club”, Pulte Home Corporation, Subdivision No. 8088.

RECOMMENDATION
Approve a Resolution accepting the offers of dedication for easements for ingress and egress for emergency vehicles for parcels “A” through “E” (private streets: Centennial Drive-Parcel “A”; Centennial Drive-Parcel “B”; Suntan Lane-Parcel “C”; Burghley Lane-Parcel “D” and Bonum Way-Parcel ”E”); accepting the offers of dedication for Parcel “H” and areas marked as “P.S.E.” (Public Service Easement) for public use for public services and utility purposes; accepting the offers of dedication for the area marked as “D.W.E.” (Domestic Water Easement) as dedicated to the City of Brentwood for public use for domestic water line purposes as shown on the Final Map; accepting the subsurface water rights relinquished on said Final Map and accepting public improvements (waterlines, sanitary sewer, storm drain and fiber optics), accepting the Subdivision Maintenance Bonds (Bond No. 6272747 in the amount of $176,399.90) and releasing the Subdivision Performance and Payment Bonds for Subdivision No. 8088, “Brentwood Country Club” by Pulte Home Corporation, located south of Balfour Road and east of the Fairview Avenue extension, south of ECCID Main Canal and just south of Wolf Road.

PREVIOUS ACTION
On December 16, 1997, Planning Commission approved Resolution No. 97-39, approving Tentative Subdivision Map No. 7940 with conditions.

On February 10, 1998, City Council approved Resolution No. 98-31, revising certain conditions of approval for Tentative Subdivision Map No. 7940.

On June 25, 2002, City Council approved Resolution No. 2584, approving the Subdivision No. 8088 Final Map, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.

BACKGROUND
The Final Map, located south of Wolf Road and east of the Fairview Avenue extension, is part of the Summerset Active Adult Community and was recorded on July 10, 2002, in Book 444 of Maps, at Page 20, Contra Costa County Records. The subdivision contains 80 single-family residential lots. In conjunction with the Final Map, the Developer provided Performance and Payment Bonds. The following are the major improvement quantities installed: 2,566 L.F. of 8” sanitary sewer line, 1,480 L.F. of 24” sanitary sewer line, 3,932 L.F. of 8” waterline, 671 L.F. of 12” waterline, 251 L.F of 24” waterline, 3,065 L.F. of 18” storm drain line, 4,417 L.F. of 4’ wide sidewalk, 5,700 L.F. of curb and gutter, 139,671 S.F. of pavement, 59 streetlights, 294 street trees and 4,603 L.F. of joint trench. A final inspection of the street improvements found them to be completed and in conformance with the approved improvement plans.
Parcels “A” through “E” are private streets for which an easement for ingress and egress for emergency vehicles were offered for dedication to the City of Brentwood on the Final Map. In addition, areas marked “P.S.E” (Public Service Easement), “D.W.E.” (Domestic Water Easement) and Parcel “H” were offered for dedication to the City of Brentwood on the Final Map for public use. When the Final Map was approved by City Council, the offers of dedication were subject to the acceptance of improvements. Now that the above improvements have been completed, the City must accept these improvements in order to obtain title to the easements and parcels offered on the Final Map. The Developer for Subdivision No. 8088, Pulte Home Corporation, also has provided Maintenance Bonds (Bond No. 6272747 in the amount of $176,399.90) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of the improvements, the City will then incur costs of approximately $11,800 per year, associated with necessary repairs of utilities. The maintenance for private streets will be done by the Homeowner’s Association. The storm drain maintenance (funded by the General Fund, Measure “C” and gas taxes) will cost approximately $736 per year. The sewer and water maintenance (funded through respective enterprise funds) will cost approximately $4,856 per year for sewer maintenance and approximately $6,157 per year for water maintenance. A Lighting and Landscaping Assessment District (LLD No. 94-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL RIGHT-OF-WAY, PARCELS, EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP; ACCEPTING SUBSURFACE MINERAL RIGHTS AND ACCEPTING ALL ON-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8088, “ BRENTWOOD COUNTRY CLUB”, BY PULTE HOME CORPORATION, LOCATED SOUTH OF WOLF ROAD AND EAST OF THE FAIRVIEW AVENUE EXTENSION.


WHEREAS, on December 16, 1997, by Planning Commission Resolution No. 97-39,

WHEREAS, on June 25, 2002, City Council approved Resolution No. 2584, approving the Final Map of Subdivision No. 8088, Pulte Home Corporation, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance, and the offers of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds for in-tract improvements for Subdivision No. 8088, to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted for parcels “A” through “E” for ingress and egress for emergency vehicles, all areas marked as “P.S.E.” (Public Service Easement) for public use of the private streets, Parcel “H” and “D.W.E.” (Domestic Water Easement) and subsurface water rights as shown on the Final Map of Subdivision No. 8088.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
