RECOMMENDATION
Approve a Resolution authorizing the City Manager to enter into a Professional Services Agreement with Vali Cooper & Associates, Inc. for Parks and Recreation Inspection Services for new development and Capital Improvement Projects in the amount of $321,300, and authorize the City Manager to approve change orders up to 10% of the contract amount.

PREVIOUS ACTION
On April 22, 2003, the City Council approved a Resolution authorizing the City Manager to enter into a Professional Services Agreement with Vali Cooper & Associates, Inc. for Engineering Inspection Services for new development and Capital Improvement Projects (CIP) in the amount of $122,558.40, and authorized the City Manager to approve change orders up to 10% of the contract amount.

On August 28, 2003, the City Council approved a Resolution authorizing the City Manager to execute a contract amendment with Vali Cooper & Associates, Inc. for Engineering and Parks and Recreation Inspection Services for new development and Capital Improvement Projects in the amount of $122,558.40, and authorized the City Manager to approve change orders up to 10% of the contract amount.

BACKGROUND
The City of Brentwood has experienced an enormous amount of residential and commercial landscape development in the last few years. The number of parks, streetscapes, residential and commercial landscape infrastructure projects created by new development and the City’s Capital Improvement Projects (CIP) continue to increase. Inspection services are an integral part of the construction process for quality control and to verify that all improvements are constructed in conformance with City and State standards. Having good quality control during construction reduces maintenance costs.

Recently with the support of the other development services departments, the Parks and Recreation Department has become responsible for the review, plan check and inspection of all landscape projects in addition to park landscape projects. The Parks and Recreation Department has one full time Construction Inspector who is paid through Park Development Funds. Now that the department is responsible for all landscape review and inspection, additional inspection staff and respective fees are necessary for all non-park related projects.

Vali Cooper & Associates, Inc., has done an excellent job for the City providing contract inspection services on an as-needed basis and are self contained with their own vehicles and equipment. This proposal is based on the expected need of 1.5 inspectors for fiscal year 2004/05, so the department has inspectors available when needed, as opposed to hiring additional full time staff. Contract inspectors will only be used as needed, with related costs paid by specific developers.

To insure confirmation of competitive rates and services, staff will conduct a request for services of all interested companies prior to the approval of the 2005/06 City budget.

FISCAL IMPACT
This proposed budget has been approved by City Council as a part of the fiscal year 2004/05 City of Brentwood Budget. Currently developer inspection fees are being studied to enable the Parks and Recreation Department to establish fees to recoup this inspection cost from the developers requiring the inspection services. A recommendation of these fees will be presented to City Council for approval when the study is complete.

FOR PARKS AND RECREATION INSPECTION SERVICES FOR NEW DEVELOPMENT AND CAPITAL IMPROVEMENT PROJECTS IN THE AMOUNT OF $321,300, AND AUTHORIZE THE CITY MANAGER TO APPROVE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT.

WHEREAS, the City of Brentwood has experienced an enormous amount of residential and commercial landscape development in the last few years; and

WHEREAS, inspection services are an integral part of the construction process for quality control and to verify that all improvements are constructed in conformance with City and State standards; and

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to enter into a Professional Services Agreement with Vali Cooper & Associates, Inc. for Parks and Recreation Inspection Services for new development and Capital Improvement Projects in the amount of $321,300, and authorize the City Manager to approve change orders up to 10% of the contract amount.
