REDEVELOPMENT AGENCY AGENDA ITEM NO. 3

Meeting Date: June 8, 2004

Subject/Title: Approve temporary use permit of Agency-owned property for CornFest 2004 parking from July 7 through July 11, 2004

Prepared by: Gina Rozenski, Redevelopment Manager

Submitted by: Howard Sword, Economic Development Director

RECOMMENDATION
Approve temporary use permit of Agency-owned property for CornFest 2004 parking from July 7 through July 11, 2004.

PREVIOUS ACTION
On April 13, 2004, the City Council approved an amendment to the code section for Temporary Use Permits. The amended code provides that: “Any Temporary Use requesting the closure of City right-of-way requires the approval of the City Council, except those street closures permitted to be exercised by the Chief of Police, City Engineer, and the Director of Public Works as provided in Brentwood Municipal Code, Title 10 and other provisions of City policy, regulations, and the Municipal Code.”
Earlier this evening, the Council will consider approval of the closure of City right-of-way and a Temporary Use Permit for the CornFest 2004.
BACKGROUND
The Brentwood CornFest Committee has requested use of the Agency-owned property located at the corner of Oak and Walnut Streets for parking. For many years, the CornFest Committee has used this property as designated parking areas, in conjunction with the safety measures and efforts of the Brentwood police.

The Redevelopment Agency will be added as additional insured in the insurance coverage purchased by the Cornfest Committee for the event, and the Committee will indemnify the Redevelopment Agency against all claims, liability and loss resulting directly or indirectly from operations and activities on the property. The Committee has further agreed to leave the property in a clean and orderly condition upon completion of the festival.

FISCAL IMPACT
None.
