Subject/Title: Approve a Resolution approving an Affordable Housing Agreement between the City of Brentwood and Meritage Homes of Northern California for Tracts 8546 and 8603, Sterling Pinnacle Project

RECOMMENDATION
Approve a Resolution approving an Affordable Housing Agreement between the City of Brentwood and Meritage Homes of Northern California for Tract 8546, Sterling Pinnacle Project.

PREVIOUS ACTION
Ordinance 756 was adopted by the City Council on September 9, 2003 creating the City of Brentwood Affordable Housing Program. At its meeting of April 15, 2004 the Housing Subcommittee recommended approval of the Affordable Housing Agreement with Mission Peak Homes of Northern California for Tracts 8546 and 8603, Sterling Pinnacle Project. On May 11, 2004 City Council directed staff to place affordable housing agreements on the City Council consent calendar for consideration and approval.

BACKGROUND
The City Council approved Ordinance 756 “An Ordinance of the City Council of the City of Brentwood Approving and Amendment to the Municipal Code Adding Chapter 17.725 that Establishes and Affordable Housing Program” on September 9, 2003. The Ordinance requires that developers of residential projects assist in increasing the supply of very-low and low income housing through creation of ten percent of the units as affordable housing. It further creates an in-lieu housing fee for creation of these units and offers the developers several alternative equivalent methods to provide these affordable units through dedication of units to the City’s rental program, dedication of land, purchase of market units currently for sale and reselling them at affordable costs and other equivalents as negotiated by the City Manager or his designee.

Meritage Homes of Northern California, Tract 8546, Sterling Pinnacle Subdivision was approved and final maps were recorded prior to the establishment of the affordable housing program by the City—thus, making this a “transitional” project since the final recorded map did not reflect smaller lots for affordable housing purposes. The lots for the project average over 8500 square feet. However, the project was approved with a condition of approval to comply with any affordable housing program adopted by the City. As such the following was negotiated with Meritage Homes to provide affordable housing in the Sterling Pinnacle subdivision keeping in mind that this is a transitional project:

1) Meritage will pay an in-lieu fee in the amount of $889,174.22 prior to the issuance by the City of the 50th building permit for Tract 8603; and

2) Developer shall construct and sell a duplex on the project site. The developer shall commence construction of the duplex prior to the issuance by the City of the 100th building permit for Tract 8603. The developer shall sell one unit in the duplex to a very-low income household and the remaining unit in the duplex to a low-income household. Each unit shall be sold subject to the deed restrictions required pursuant to the provisions of the Ordinance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN AFFORDABLE HOUSING AGREEMENT WITH MERITAGE HOMES OF NORTHERN CALIFORNIA, INC, FOR TRACTS 8546 AND 8603, STERLING PINNACLE PROJECT

WHEREAS, on September 9, 2003, the City Council adopted Ordinance 756, an Ordinance of the City Council of the City of Brentwood approving an amendment to the Municipal Code adding Chapter 17.725 that establishes an Affordable Housing Program; and

WHEREAS, Meritage Homes of Northern California recorded final maps for Subdivisions 8546 and 8603; and

WHEREAS, Meritage Homes of Northern California had a Condition of Approval to their project to comply with the City of Brentwood Affordable Housing Program; and

WHEREAS, the Developer has agreed to pay in lieu fees in the amount of $889, 174.22 prior to the issuance by the City of the 50th building permit for Tract 8603; and

WHEREAS, the Developer has agreed to construct a sell a duplex on the project site—one unit for very-low income household and one unit for a low income household at the appropriate sales prices as determined by the City and subject to deed restrictions required pursuant to the provisions of the Ordinance.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve an Affordable Housing Agreement with Meritage Homes of Northern California, Inc. for Tracts 8546 and 8603, Sterling Pinnacle Project.
