Reject the claim of Sandra Yates presented on February 24, 2004 as
recommended by the City’s third party adjuster, Contra Costa County
Municipal Risk Management Insurance Authority and the City Attorney.
Claimant, Sandra Yates, presented a claim in the amount of $1,238.44 for
four tires. Claimant states that on February 17, 2004 she was driving
eastbound from her home on Apricot Way towards Fairview when she ran over
nails causing damage to her tires. She further states that the area was
under construction by numerous contractors and that she could not determine
which one was at fault. Apricot Way was once a paved two-lane roadway and it
is presently under construction for widening it to a four-lane divided
The public improvements associated with the various developments have not
been accepted by the City. There are subdivision improvement agreements that
provide the City indemnity rights for defense and indemnity for claims
arising from the improvements.
