Subject/Title: Approve a Resolution authorizing the destruction of certain obsolete records for the City Clerk’s Department.

RECOMMENDATION
Approve a Resolution authorizing the destruction of certain obsolete records, dated 1976 through 1995, for the City Clerk’s Department.

PREVIOUS ACTION
On May 10, 1983, Resolution No. 83-19 was adopted implementing Council Policy 00-4 and the City’s Records Retention Program. On December 10, 1996, Resolution No. 96-208 amended the City’s Records Retention Program and approved the Records Retention Guide.

BACKGROUND
The City Council adopted City’s Records Retention Guide, authorizing the destruction of certain records without the approval of the legislative body or written consent of the City Attorney. Items not listed in the City’s Records Retention Guide may be destroyed with written consent of the City Attorney and approval of the legislative body by resolution. The obsolete records listed in the Resolution are not included in the City’s Records Retention Guide and require approval by the legislative body.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE DESTRUCTION OF CERTAIN OBSOLETE RECORDS FOR THE CITY CLERK’S DEPARTMENT.

WHEREAS, Section 34090 of the Government Code provides that certain City records may be destroyed by the head of a City department with written consent of the City Attorney and approval of the legislative body by resolution; and

WHEREAS, the City Clerk’s Department has obtained written consent of the City Attorney on the appropriate form entitled “Request for Authority to Destroy Obsolete Records” as filed in the Office of the City Clerk.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BRENTWOOD RESOLVES AS FOLLOWS:

Section 1. The City Council hereby approves the destruction of the following obsolete records, dated 1976 through 1995:

Applications, Absentee Ballots and Envelopes

Candidate Statements

Certificates of Election

Nomination Papers; Successful, Unsuccessful

Notifications and Publications

Oaths of Office

Petitions and Notice of Intent to Circulate Petitions

Section 2. The City Clerk’s Department shall be authorized to destroy the records.

Section 3. That this resolution shall become effective immediately upon its passage and adoption.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 25th day of May, 2004 by the following vote:
