Subject/Title: Approve a Resolution accepting the work performed by Top Grade Construction, Inc. for the construction of Brentwood Boulevard Widening, CIP Project No. 336-3054.

RECOMMENDATION
Approve a Resolution accepting the work performed by Top Grade Construction, Inc. for the construction of the Brentwood Boulevard Widening, CIP Project No. 336-3054, and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 26, 1998, the City of Brentwood approved an updated Master Agreement between the City of Brentwood and the State of California Federal Aid Projects 04-5300.

On May 8, 2001, City Council approved Resolution No. 2284 authorizing the City Manager to execute Program Supplement Agreement No. 003-M to Administering Agency-State Agreement No. 04-5300 for reimbursement of cost for right-of-way, construction and construction engineering for the Brentwood Boulevard Widening, CIP Project No. 336-3054.

On September 24, 2002, City Council authorized the award of the construction contract for the Brentwood Boulevard Widening to Top Grade Construction, Inc. in the amount of $1,877,645.70, plus change orders up to 10% of the contract amount.

On May 21, 2003, the California Transportation Commission approved funding of $250,000 under the Environmental Enhancement and Mitigation (EEM) Program for the Brentwood Boulevard Widening project.

On June 23, 2003, a reimbursement agreement between the State and the City of Brentwood was executed under the Environmental Enhancement and Mitigation Program for a maximum reimbursement amount of $250,000.

On September 9, 2003, City Council authorized the City Manager to execute a contract change order with Top Grade Construction, Inc. in the amount of $121,450 plus a 10% contingency for enhanced landscaping funded through the Environmental Enhancement and Mitigation (EEM) Program.

BACKGROUND
The subject project provided for the widening of Brentwood Boulevard between Applewood Common and Village Drive from two-lanes to four-lanes and related improvements including new medians, sidewalk, bike lanes, utilities, landscaping and traffic signal modifications. The authorized construction contract with Top Grade Construction, Inc. provided for the bid amount of $1,877,645.70 plus a 10% contingency for a total contract amount of $2,065,410.27. The construction of contract work and related contingencies has amounted to $2,057,817.93 and has stayed within the original 10% contingency. Approximately 89% of this amount is reimbursable from federal grant funds administered through the state.

The authorized EEM change order for $121,450 plus a 10% contingency for a total change order amount of $133,595 provided for an increase in the size and quantity of the trees under the original contract and related modifications to the irrigation system. The work performed under this change order has amounted to $122,321.50 and has stayed within the original 10% contingency. The costs associated with this change order are fully reimbursable from the state through the EEM program.

The contractor has met all the contractual requirements to accept the work. This acceptance by the City Council is an administrative action necessary to formally close the project.

FISCAL IMPACT
The 2003/2004 CIP Budget contains sufficient funds for construction of the Brentwood Boulevard Widening, CIP Project No. 336-3054.

Brentwood Boulevard is maintained by Caltrans. The City of Brentwood will maintain the landscaped area within the roadway median and parkway area. It is anticipated the annual maintenance cost will be approximately $12,000. The funds will be obtained from the General Fund, existing Landscape and Lighting District No. 02-5 and a future Landscape and Lighting District to be formed upon development of the eastside of Brentwood Boulevard.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO ACCEPT THE WORK PERFORMED BY TOP GRADE CONSTRUCTION, INC. FOR THE BRENTWOOD BOULEVARD WIDENING, CIP PROJECT NO. 336-3054 AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, on September 24, 2002, City Council authorized the award of the construction contract to Top Grade Construction, Inc. in the amount of $1,877,645.70 plus a 10% contingency; and

WHEREAS, on September 9, 2003, City Council authorized the City Manager to execute a change order with Top Grade Construction, Inc. for enhanced landscaping in the amount of $121,450 plus a 10% contingency for the Brentwood Boulevard Widening, CIP Project No. 336-3054; and

WHEREAS, the contractor has met all the contractual requirements to accept the work and this acceptance is an administrative action necessary to formally close the project.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the Brentwood Boulevard Widening, CIP Project No. 336-3054, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for the project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on September 24, 2002, enter into an agreement with Top Grade Construction, Inc. for the construction of the Brentwood Boulevard Widening, CIP Project No. 336-3054; located on Brentwood Boulevard between Applewood Common and Village Drive in Brentwood, California.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete the said project.

On May 25, 2004, the said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
