RECOMMENDATION
Approve resolutions for joint use facilities between the City of Brentwood and Brentwood Union School District at Pioneer Elementary School, Grant Street Elementary School, and American Avenue Middle School.

PREVIOUS ACTION
June 22, 1993, City Council approved Resolution No. 93-136, approving the joint use agreement between the City of Brentwood and Brentwood Union School District related to the Bristow Middle School multi-use building.

July 22, 1997, City Council approved Resolution No. 97-164 approving the joint use agreement between the City of Brentwood and BUSD related to Edna Hill Gymnasium.

September 18, 2001, City Council approved a joint use agreement between the City and BUSD for the joint use and scheduling of City/BUSD facilities.

January 8, 2002, City Council approved a joint use agreement between the City and BUSD for Garin Elementary School Multi-purpose room facility.

BACKGROUND
The City of Brentwood and Brentwood Union School District have a longstanding working relationship in the development and use of joint use facilities. Many of these joint use facilities also qualify for matching money from the State of California due to the joint use relationship that exists. In working together, the City and BUSD have entered into a shared cost relationship for the funding of middle school gymnasiums, which the City then operates and reserves for City and community use after school hours.

The City and BUSD also worked together on the multi-purpose room at Garin Elementary School, a relationship that did not require direct City funding, but qualified BUSD for money from the State for construction of the facility.

Brentwood Union School District is again requesting matching money from the State of California for three projects and requesting support from the City of Brentwood for their application. The first two projects, patterned after the Garin Elementary School multi-purpose facility, are requests for Pioneer Elementary School (Empire Avenue/Amber Lane/Shady Willow Lane), and the planned elementary school to be located at the corner of Grant Street and Anderson Lane. These two requests need a resolution of support from the City but do not require matching funds by the City.

The third request for matching money from the State of California is for the BUSD third middle school gymnasium, to be constructed adjacent to Heritage High School on American Avenue. This request will require a match of funds from the City in the same manner as the gymnasiums at Bristow and Edna Hill middle schools. This request has been included in the City of Brentwood draft 2004/05 – 2008/09 CIP program and is a funded expense in years 2007/08 and 2008/09 through park development facility fees.

The Brentwood Union School District Board of Trustees approved joint use resolutions between the City and BUSD at their May 12, 2004, Board meeting. Staff is recommending approval of the three resolutions in support of the Brentwood Union School District application for available funds for construction of joint use facilities at Pioneer Elementary School, Grant Street Elementary School, and American Avenue Middle School. Once approved, staff will be returning with a revised joint use agreement between the City and BUSD for the operation and scheduling of joint use facilities, which will be updated to include all respective school sites.

BUSD Superintendent J. Douglas Adams will be in attendance at the meeting in case City Council has any specific questions regarding the joint use facility resolutions.

FISCAL IMPACT
Pioneer Elementary School and Grant Street Elementary School multi-purpose facilities do not require matching funds. The American Avenue Middle School joint use gymnasium is a funded project in the draft 2004/05 – 2008/09 City of Brentwood CIP program.

RESOLUTION NO.

APPROVE A RESOLUTION FOR JOINT USE FACILITIES BETWEEN THE CITY OF BRENTWOOD AND BRENTWOOD UNION SCHOOL DISTRICT FOR PIONEER ELEMENTARY SCHOOL.

WHEREAS, the Brentwood Union School District Board has applied for a grant from the State Allocation Board to fund a joint use project and construct a facility on a kindergarten through grade 12 schoolsite in the Brentwood Union School District;

WHEREAS, the City of Brentwood intends to enter into a Joint Use agreement with the Brentwood Union School District in accordance with California Education Code section 17077.40 et seq. regarding use of the facility described above;

WHEREAS, the City of Brentwood and Brentwood Union School District intend that the Joint Use Agreement will specify the method of sharing capital and operating costs, relative responsibilities for the operation and staffing of the facility, and the manner in which the safety of the pupils and community will be ensured;

WHEREAS, the City of Brentwood and Brentwood Union School District intend that the Joint Use Agreement will specify the amount of the contribution to be made by Brentwood Union School District and the City of Brentwood toward the 50 percent local share of eligible project costs;

WHEREAS, the City of Brentwood and Brentwood Union School District intend that the facility will be used to the maximum extent possible for both school and community purposes;

WHEREAS, the facility qualifies for funding under paragraph (1) of subdivision (b) of Section 17077.40;

WHEREAS, Brentwood Union School District has received or anticipates receiving all approvals necessary for apportionment under California Education Code 17070.10 et seq.;

NOW, THEREFORE, BE IT RESOLVED, that the City of Brentwood authorizes the City Manager or his designee to support the application made by the Brentwood Union School District for available funds for construction of a joint use facility, specifically the Pioneer Elementary Multi Purpose Room.
