Subject/Title: Authorize the City Manager to Execute a Contract with Pacific Gas and Electric (PG&E) for CIP Project No. 336-3143.

RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute a contract with Pacific Gas and Electric (PG&E) in an amount not to exceed $67,290.62 for the undergrounding of the existing 21 kV Overhead Distribution Power Line on Shady Willow Lane along the Golden Hills Church frontage and approve change orders up to 10% of the contract amount for the Shady Willow Lane Extension, CIP Project No. 336-3143.

PREVIOUS ACTION
On May 27, 2003, by Resolution No. 2868, City Council adopted the City’s 2003/04 – 007/08 Capital Improvement Program that included the Shady Willow Lane Extension – Phase I, CIP Project No. 336-3143.

On October 14, 2003, by Resolution No. 3003, City Council certified the Environmental Impact Report of Shady Willow Lane and Amber Lane.

BACKGROUND
Shady Willow Lane is one of the major north south corridors connecting commercial centers on Lone Tree Way and Sand Creek Road in the Northwest Quadrant of Brentwood. Different developments will be constructing their portions of Shady Willow Lane this summer to complete the missing links between Lone Tree Way and Sand Creek Road, to provide the necessary improvements. Completion of Shady Willow Lane will provide the necessary infrastructure to develop the mixed use business park zoned areas between the Hwy 4 Bypass and Shady Willow Lane.

The attached contract is for Pacific Gas and Electric (PG&E) to underground the existing 21 kV Overhead Distribution Power Line on Shady Willow Lane along the Golden Hills Church frontage. This relocation is necessitated by the widening of Shady Willow Lane and Golden Hills Church obligation by City ordinance to underground along their property frontage. Golden Hills Church has funded for these improvements through Assessment District No. 2002/01. These improvements will improve the aesthetics of the area by removing the 21 kV overhead power lines and placing the facility underground in a joint trench with other utilities (SBC, Comcast, fiber optics, etc.). If this agreement is approved by City Council, PG&E will then commence with all necessary work and inspections for installing a new joint trench along the west side of Shady Willow Lane along the Golden Hills Church project frontage. It is critical for PG&E to commence with construction of this work. Arbor Ridge Apartments is conditioned to build Shady Willow Lane Extension to its ultimate condition, from the southerly boundary of the apartment complex to Lone Tree Way, and the contractor has mobilized to the site and is ready to begin these improvements.

FISCAL IMPACT
The Fiscal Year (FY) 2003/04 budget contains funds for the Shady Willow Lane Extension, CIP Project No. 336-3143, in the amount of $2,258,500. The construction portion of the FY 03/04 budget is $1,181,000. The cost to underground the existing 21kV is funded by developments.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH PACIFIC GAS AND ELECTRIC (PG&E) IN AN AMOUNT NOT TO EXCEED $67,290.62, AND APPROVE CHANGE ORDERS UP TO 10% OF THE CONTRACT AMOUNT FOR THE UNDERGROUNDING OF THE EXISTING 21 kV OVERHEAD DISTRIBUTION POWER LINE ON SHADY WILLOW LANE ALONG THE GOLDEN HILLS CHURCH PROJECT FRONTAGE FOR CIP PROJECT NO. 336-3143.

WHEREAS, on May 27, 2003, by Resolution No. 2868, City Council adopted the City’s 2003/04 – 007/08 Capital Improvement Program that included the Shady Willow Lane Extension – Phase I, CIP Project No. 336-3143; and

WHEREAS, on October 14, 2003, by Resolution No. 3003, City Council certified the Environmental Impact Report of Shady Willow Lane and Amber Lane, a portion of the Northwest Quadrant Infrastructure; and

WHEREAS, the undergrounding of the 21 kV Overhead Distribution Power Line by Pacific Gas and Electric is part of the Shady Willow Lane Extension project as shown on the improvement plans.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute a contract with Pacific Gas and Electric for the undergrounding of the existing 21 kV Overhead Distribution Power Line for the Shady Willow Lane Extension, CIP Project No. 336-3143, in an amount not to exceed $ 67,290.62, and further authorizes the City Manager to approve change orders up to 10% of the contract amount.
