Subject/Title: Approve a Resolution amending the 2003/04 Operations Budget to include an
additional $80,500 for the Arts Commission

RECOMMENDATION
Staff recommends that the 2003/04 Operations Budget for the Arts Commission be amended to include an additional $80,500. This action is necessary so that the money that was donated by Shea Homes, and was received by the City, can be placed in the appropriate budget so that the Arts Commission can utilize the money.

PREVIOUS ACTION
On May 14, 2002 Shea Homes went before City Council offering to provide $7,000 per custom lot for funding of programs/improvements such as Low Income Housing, Roadway Improvements, and Arts Commission and Economic Development contributions.

At the Public Hearing on January 14, 2003, City Council requested that Shea Homes provide additional information on the work they have done to substantiate the fact that the custom homes are not workable on the lots.

At the City Council meeting on January 28, 2003, Ordinance 735 was passed amending Planned Development Zone No. 22 to eliminate the reference to the originally approved 23 custom home lots on 5.1 acres located west of the Highway 4 Bypass and north of the Shadow Lakes development.

BACKGROUND
On January 14, 2003 a public hearing was held to clarify that the $7,000 per custom lot offered by Shea Homes was negotiated and recommended by the Housing Subcommittee. The recommendation of the Subcommittee was to split the money equally between PAL and the Arts Commission. On January 28, 2003, City Council waived the second reading of Ordinance 735 approving the recommendation by the Housing Subcommittee. On March 31, 2003, Shea Homes contributed $161,000 for twenty-three custom home lots at $7,000 each; $80,500 was deposited into the Parks & Recreation/Arts Commission enterprise fund in March 2003.

FISCAL IMPACT
The proposed $80,500 shall be funded from the Parks & Recreation/Arts Commission enterprise fund.

APPROVE A RESOLUTION AMENDING THE 2003/04 OPERATIONS BUDGET TO INCLUDE AN ADDITIONAL $80,500 FOR THE ARTS COMMISSION

WHEREAS, On May 14, 2002 Shea Homes went before City Council offering to provide $7,000 per custom lot for funding of programs; and

WHEREAS, the Housing Subcommittee recommended splitting the contribution equally between PAL and the Arts Commission; and

WHEREAS, City Council approved Ordinance No. 735 on January 28, 2003; and

WHEREAS, Shea Homes contributed $161,000 to the City of Brentwood on March 31, 2003; and

WHEREAS, this action is needed to transfer the money into the appropriate fund for Arts Commission utilization;

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby approves that the 2003/04 Operations Budget be amended.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 13th day of April. 2004 by the following vote:
