Subject/Title: Approve a Resolution for the Acceptance of Improvements for Brentwood Park Phase II, Pulte Homes, Subdivision No. 8402.

RECOMMENDATION
Approve a Resolution accepting the offers of dedication in-fee for the right-of-way of Kenwood Drive, Ascot Court, Atherton Place, Begonia Drive, Begonia Place, Buckeye Court, Buckeye Place, Dahlia Drive, Iris Court, Hawthorn Drive and Hawthorn Place for public use as shown on the Final Map; accepting the offers of dedication for all the easements, abutter’s rights, sub-surface mineral and water rights and accepting all on-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics, and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Subdivision No. 8402, Pulte Homes, located north of Lone Tree Way and just east of O’Hara Avenue.

PREVIOUS ACTION
On September 16, 1999, Planning Commission of the City of Brentwood approved Resolution No. 99-48, approving the Tentative Map of Subdivision No. 8226, Brentwood Park, with conditions.

On August 28, 2001, City Council approved Resolution No. 2348, approving the Final Map of 108 lots in Subdivision No. 8402, with improvement securities and a Subdivision Improvement Agreement. At the same time, City Council accepted on behalf of the public offers of dedication in fee, designated as Parcels A, B and E on said map.

On August 27, 2002, City Council approved Resolution No.2647 to execute a quitclaim deed and any other documents necessary to terminate the City’s interest in the offer of dedication of Parcel A as shown on Subdivision No. 8402 Final Map, since the developer has requested vacation and reconveyance of Parcel A.

On September 11, 2002, per Doc. No. 2002-0321895-00, Lot Line Adjustment No. 02-11 was recorded to transfer approximately one-half of Parcel A to Lot No. 58 and the other half to Lot No. 70, as shown on the Final Map for Subdivision No. 8402.

BACKGROUND
The Final Map is a portion of the Pulte Homes, Brentwood Park development and is located north of Lone Tree Way and east of O’Hara Avenue, and was recorded on September 7, 2001, in Book 434 of Maps, at Page 1, Contra Costa County Records. The Subdivision contains 108 single-family residential lots. All the public improvements, including the widening of O’Hara Avenue and Anderson Avenue as required by the conditions of approval for this subdivision have been constructed and inspected by the City inspector. In conjunction with the Final Map, the Developer has provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

Following are the major improvement quantities installed: 4,045 LF of 8” sanitary sewer lines, 4,650 LF of 8” waterlines, 584 LF of 12” waterlines, 141 LF of 30” storm drain lines, 764 LF of 24” storm drain lines, 1136 LF of 18” storm drain lines, 738 LF of 12” storm drain lines, 9,147 LF of sidewalk, 9,147 LF of curb and gutter, 179,684 SF of pavement, 30 streetlights and 226 trees.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the said parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8402, Pulte Homes, has already provided a Maintenance Bond (Bond No. 6203472 in the amount of $291,600) to cover the twelve-month warranty period for the on-site improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur annual costs in the amount of approximately $24,300 for on-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the General Fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 00-04) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR STREET RIGHT-OF-WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8402, PULTE HOMES, LOCATED NORTH OF LONE TREE WAY AND EAST OF O’HARA AVENUE.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedication in-fee are hereby accepted for right-of-way of Kenwood Drive, Ascot Court, Atherton Place, Begonia Drive, Begonia Place, Buckeye Court, Buckeye Place, Dahlia Drive, Iris Court, Hawthorn Drive and Hawthorn Place, and that the offers of dedication are hereby accepted for all easements as shown on the Final Map of Subdivision No. 8402.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
