Subject/Title: Approve a Resolution for the Acceptance of Improvements for Tuscany Unit 3, Beck Properties, Inc., Subdivision No. 8369.

RECOMMENDATION
Approve a Resolution accepting the offers of dedication in-fee for the right-of-way of Corniglia Lane, Gaiole Court, Santa Margherita Way, San Jose Avenue, San Donato Court, Rapallo Court and Portofino Drive for public use as shown on the Final Map; accepting the offers of dedication for all the easements, abutter’s rights, sub-surface mineral and water rights and accepting all on-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics, and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Subdivision No. 8369, Beck Properties. Inc., located south of San Jose Avenue and just east of the Hwy 4 Bypass.

PREVIOUS ACTION
On September 5, 2000, Planning Commission of the City of Brentwood approved Resolution No. 00-59, approving the Tentative Map of Subdivision No. 8369, Tuscany Unit 3, with conditions.

On June 25, 2002, City Council approved Resolution No. 2583, approving the Final Map for 51 lots of Subdivision No. 8369 with improvement securities and a Subdivision Improvement Agreement.

On January 14, 2003, City Council approved Resolution No. 2774, accepting in-fee dedication of Parcel “A”, Subdivision No. 8369, and authorizing the City Manager to execute a lease with Pac Bell Wireless, (dba) Cingular Wireless, for use of a portion of Parcel “A”.

BACKGROUND
The Final Map is a portion of the Beck development and is located south of San Jose Avenue and east of the Hwy 4 Bypass, and was recorded on July 10, 2002, in Book 444 of Maps, at Page 14, Contra Costa County Records. The Subdivision contains 51 single-family residential lots. All the public improvements, including the widening of San Jose Avenue and the school driveway relocation as required by the conditions of approval for this subdivision, have been constructed and inspected by the City inspector. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

Following are the major improvement quantities installed: 1,610 LF of 8” sanitary sewer lines, 1,756 LF of 8” waterlines, 829 LF of 24” storm drain lines, 1029 LF of 18” storm drain lines, 2,800 LF of sidewalk, 2,800 LF of curb and gutter, 106,400 SF of pavement, 21 streetlights and 170 trees.
The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the said parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8369, Beck Properties Inc., has already provided a Maintenance Bond (Bond No. 877992S in the amount of $118,371) to cover the twelve-month warranty period for the on-site improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of approximately $11,000 for on-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the General Fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 99-9) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR STREET RIGHT-OF-WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8369, BECK PROPERTIES INC., LOCATED SOUTH OF SAN JOSE AVENUE AND EAST OF THE HWY 4 BYPASS.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedication in-fee are hereby accepted for right-of-way of Corniglia Lane, Gaiole Court, Santa Margherita Way, San Jose Avenue, San Donato Court, Rapallo Court and Portofino Drive, and that the offers of dedication are hereby accepted for all easements as shown on the Final Map of Subdivision No. 8369.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
