RECOMMENDATION
Approve a Resolution to approve and adopt the proposed speed limits for various segments of roadway within the City of Brentwood.

PREVIOUS ACTION
On March 25, 1997, City Council approved Resolution No. 97-68 to establish speed surveys on various roadway segments.

BACKGROUND
According to the California Vehicle Code Section 22354, 22355, 22357, 22358, and 40802, local agencies are required to perform radar speed surveys and implement roadway speed limits with appropriate signage.

Furthermore, whenever the local agency builds new roadways or changes roadway characteristics significantly to facilitate the orderly movement of vehicular traffic, the local agency may by ordinance determine and declare the appropriate speed limit of 30, 35, 40, 45, 50, 55, whichever is found most appropriate with an engineering and speed survey. To provide proper circulation and improve safety for the public, staff performed speed surveys throughout the City at various locations. After analyzing the engineering and traffic survey, the Traffic Engineer determined the proposed speed limits (Exhibit “A”) using 85th percentile (rounding to the nearest 5 mph increment) from the survey.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO AUTHORIZE THE CITY MANAGER TO APPROVE AND ADOPT THE PROPOSED SPEED LIMITS DERIVED FROM THE CITYWIDE SPEED SURVEY.

WHEREAS, Division 11, Chapter 7, Article 1 of the California Vehicle Code (Section 22348 et seq.) provides the mechanism for local authorities to “determine and declare” a prima facie speed limit in excess of 25 mph on the basis of an engineering and traffic survey; and

WHEREAS, Division 11, Chapter 7, Article 1 of California Vehicle Code (Section 22348 et seq.) provides the mechanism for local authorities to “determine and declare” a prima facie speed limit of less than 70 mph on the basis of an engineering and traffic survey; and

WHEREAS, Title 10, Chapter 10.04 of the Brentwood Municipal Code (Section 10.04.010 et esq.) describes a procedure for the establishment of such regulations; and

WHEREAS, an engineering and traffic survey has been prepared from September 2003 to December 2003; and

WHEREAS, after analyzing the engineering and traffic survey, the Traffic Engineer determined the proposed speed limits using the 85th percentile from the survey.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the prima facie speed limit determined by the engineering and traffic survey is hereby declared as follows:

BE IT FURTHER RESOLVED that the City Manager is hereby authorized to give direction to the Traffic Engineer, per the California Vehicle Code Regulation, to establish the appropriate speed limits and to install the appropriate speed regulation signs.
