Subject/Title: Acceptance of Improvements for “Summerset at Brentwood Country Club”, Pulte Home Corporation, Subdivision No. 8085

RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for Wolfe Road, Centennial Place and Creek Road; accepting the offers of dedication for easements for ingress and egress for emergency vehicles for parcels “A” through “J” (private streets); accepting the offers of dedication for areas marked as “Public Service Easement or “P.S.E.” for public use for public services and utility purposes; accepting the offers of dedication for the areas designated as “Storm Drain Easements” or “S.D.E.” for public use for storm, flood and surface water drainage purposes; accepting the offers of dedication for the areas designated as “Sanitary Sewer Easement” or “S.S.E.” for public use for sanitary sewer line purposes as dedicated to the City of Brentwood for public use as shown on the Final Map; accepting the subsurface water rights relinquished on said Final Map and accepting public improvements (waterlines, sanitary sewer, storm drain and fiber optics), accepting the Subdivision Maintenance Bonds (Bond No. 929188969 in the amount of $272,168.60 for in-tract improvements for Subdivision No. 8085A Phase; Bond No. 6123057-0001 in the amount of $12,657.00 for Recreation Center Improvements for Subdivision No. 8085A Phase; Bond No. 929188970 in the amount of $342,417.30 for in-tract improvements for Subdivision No. 8085B Phase) and releasing the Subdivision Performance and Payment Bonds for Subdivision No. 8085 (Phase A and Phase B), “Summerset at Brentwood Country Club” by Pulte Home Corporation, located south of Balfour Road and east of the Fairview Avenue extension and just south of ECCID Main Canal.

PREVIOUS ACTION
On December 16, 1997, Planning Commission approved Resolution No. 97-39, approving Tentative Subdivision Map No. 7940 with conditions.

On February 10, 1998, City Council approved Resolution No. 98-31, revising certain conditions of approval for Tentative Subdivision Map No. 7940.

On February 27, 2001, City Council approved Resolution No. 2240, approving the Subdivision No. 8085 Final Map, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement.

BACKGROUND
The Final Map, located south of Balfour Road and east of the Fairview Avenue extension, is part of the Summerset Active Adult Community and was recorded on March 7, 2001, in Book 428 of Maps, at Page 25, Contra Costa County Records. The subdivision contains 318 single-family residential lots in both phases A and B. In conjunction with the Final Map, the developer provided Performance and Payment Bonds. The following are the major improvement quantities installed: 11,605 L.F. of 8” sanitary sewer line, 14,225 L.F. of 8” waterline and 1,439 L.F. of 12” waterline, 7,306 L.F. of 18” storm drain line, 453 L.F of 24” storm drain line, 13,870 L.F. of 4’ wide sidewalk, 55,481 L.F. of curb and gutter, 506,009 S.F. of pavement, 115 streetlights, 941 street trees, 15,701 L.F. of joint trench and 30,220 L.F. of median curb and gutter. A final inspection of the street improvements found them to be completed and in conformance with the approved improvement plans.

Wolfe Road, Centennial Place and Creek Road are public streets and were dedicated in fee on the Final Map. Parcels “A” through “J” are private streets for which an easement for ingress and egress for emergency vehicles were offered for dedication to the City of Brentwood on the Final Map. In addition, areas marked “P.S.E” (Public Service Easement), “S.D.E.” (Storm Drain Easement) and “S.S.E.” (Sanitary Sewer Easement) were offered for dedication to the City of Brentwood on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were subject to the acceptance of improvements. Now that the above improvements have been completed, the City must accept these improvements, in order to obtain title to the easements and parcels offered on the Final Map. The developer for Subdivision No. 8085, Pulte Home Corporation, also has provided Maintenance Bonds (Bond No. 929188969 in the amount of $272,168.60 for in-tract improvements for Subdivision No. 8085A Phase; Bond No. 6123057-0001 in the amount of $12,657.00 for Recreation Center Improvements for Subdivision No. 8085A Phase; Bond No. 929188970 in the amount of $342,417.30 for in-tract improvements for Subdivision No. 8085B Phase) to cover the twelve-month warranty period for these improvements.

FISCAL IMPACT
After the acceptance of the improvements, the City will then incur costs of approximately $46,000 per year, associated with necessary repairs of utilities. The maintenance for private streets will be done by the Home Owners Association. The public streets (Wolfe Road, Centennial Place and Creek Road) maintenance and storm drain maintenance (funded by the General Fund, Measure “C” and gas taxes) will cost approximately $1,900 per year. The sewer and water maintenance (funded through respective enterprise funds) will cost approximately $15,300 per year for sewer maintenance and approximately $28,800 per year for water maintenance. A Lighting and Landscaping Assessment District (LLD 94-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR ALL RIGHT-OF WAY, PARCELS, EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP; ACCEPTING SUBSURFACE MINERAL RIGHTS AND ACCEPTING ALL ON-SITE PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8085, “SUMMERSET AT BRENTWOOD COUNTRY CLUB”, BY PULTE HOME CORPORATION, LOCATED SOUTH OF BALFOUR ROAD AND EAST OF THE FAIRVIEW AVENUE EXTENSION.

WHEREAS, on December 16, 1997, by Planning Commission Resolution No. 97-39, the Planning Commission approved Tentative Subdivision Map No. 7940, with conditions; and

WHEREAS, on February 10, 1998, City Council approved Resolution No. 98-31, revising certain conditions of approval for Tentative Subdivision Map No. 7940; and

WHEREAS, on February 27, 2001, City Council approved Resolution No. 2240, approving the Final Map of Subdivision No. 8085, Pulte Home Corporation, accepting the offers of dedication shown thereon subject to acceptance of improvements, accepting the improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance, and the offers of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds (Bond No. 929188969 in the amount of $272,168.60 for in-tract improvements for Subdivision No. 8085A Phase; Bond No. 6123057-0001 in the amount of $12,657.00 for Recreation Center Improvements for Subdivision No. 8085A Phase; Bond No. 929188970 in the amount of $342,417.30 for in-tract improvements for Subdivision 8085B Phase) to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds be released within sixty (60) days of the passage of this resolution.

BE IT FURTHER RESOLVED that the offers of dedication are hereby accepted in fee for Wolfe Road, Centennial Place, Creek Road; that the offers of dedication are hereby accepted for parcels “A” through “J” for ingress and egress for emergency vehicles, all areas marked as “P.S.E.” (Public Service Easement) for public use of the private streets, “S.D.E” (Storm Drain Easement), “S.S.E” (Sanitary Sewer Easement) and subsurface water rights as shown on the Final Map of Subdivision No. 8085.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
