RECOMMENDATION
Approve a resolution authorizing submittal of a grant proposal to the Metropolitan Transportation Commission FY 2004/2005 Transportation Development Act (TDA), Article 3 Pedestrian/Bicycle Program for partial funding of the Minnesota Avenue Sidewalk Improvements Project, no CIP number assigned.

BACKGROUND
The Transportation Development Act (TDA), Public Utilities Code § 99233.3 and 99234, makes funds available in the nine-county Metropolitan Transportation Commission (MTC) region for pedestrian/bicycle purposes. MTC makes annual allocations of TDA funds to eligible claimants after review of applications submitted. All cities and counties in each of the nine MTC region counties are eligible to claim funds under TDA Article 3 if they meet criteria in § 99234 of the Public Utilities Code and if the project is included in an adopted comprehensive bikeway plan as outlined in § 2377 of the California Bikeways Act, Streets and Highways Code.

This year there is approximately $400,000 available for projects countywide. Eligible projects for these funds include construction and/or engineering of a capital project; to maintain a bikeway, which is closed to motorized traffic; for a bicycle safety education program; or to develop bicycle or pedestrian facilities plans. The City of Brentwood Bicycle Subcommittee, as well as staff from the Parks and Recreation Department and the Police Department, recommend that an application be submitted for the Minnesota Avenue Sidewalk Improvement project.

Staff, in accordance with the 2002 East Contra Costa County Bikeway Plan and the 2003/04 – 2007/08 Capital Improvement Program, and with the agreement and recommendation of the Brentwood Bicycle Subcommittee, has identified the Minnesota Avenue Sidewalk Improvements, no CIP number assigned, as a priority project for TDA grant funding.

FISCAL IMPACT
The estimated cost for this project is $200,000. In order to make the application more competitive, staff recommends a match of 84% of the estimated cost, or $168,500. Proposals have been submitted to other grant programs for funding of this project as well. Funds for the matching requirement have been budgeted from facility fees in the Minnesota Avenue Sidewalk Improvements project in the 2003/04 – 2007/08 Capital Improvement Program, no CIP number assigned.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE SUBMITTAL OF A GRANT PROPOSAL TO THE METROPOLITAN TRANSPORTATION COMMISSION (MTC) FY 2004/2005 TRANSPORTATION DEVELOPMENT ACT (TDA) ARTICLE 3 PEDESTRIAN/BICYCLE PROGRAM FOR PARTIAL FUNDING OF THE MINNESOTA AVENUE SIDEWALK IMPROVEMENTS PROJECT, NO CIP NUMBER ASSIGNED.

WHEREAS, The Transportation Development Act (TDA), Public Utilities Code (PUC) Sections 99233.3 and 99234, makes funds available in the nine-county MTC Region for pedestrian/bicycle purposes; and

WHEREAS, all cities and counties in each of the nine MTC region counties are eligible to claim funds under TDA Article 3; and

WHEREAS, MTC makes annual allocations of TDA funds to eligible claimants after review of applications submitted; and

WHEREAS, as part of the priority setting for projects, the City of Brentwood Bicycle Subcommittee, in conjunction with the Parks and Recreation Department and the Police Department, has selected the Minnesota Avenue Sidewalk Improvement project as their preferred project for application to this program.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby approves the filing of an application with MTC for partial funding of the Minnesota Avenue Sidewalk Improvement project.
