RECOMMENDATION
Approve a Resolution authorizing and approving the application for grant funds for the Roberti-Z’Berg-Harris (RZH) Block Grant Program under the California Clean Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Bond Act of 2002 and authorizing the Park and Recreation Director to conduct all negotiations and execute and submit all documents which may be necessary for the completion of the project(s).

BACKGROUND
The California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Bond Act of 2002 Roberti-Z’Berg-Harris Block Grant Program is intended to “meet the urgent need for safe, open, and accessible local park and recreational facilities for increased recreational opportunities that provide positive alternatives to social problems”. RZH grants are allocated to cities, counties and park and recreation districts on a population-based formula.

The funds are to be used for high-priority projects that satisfy the most urgent park and recreation needs, with emphasis on unmet needs in the most heavily populated and most economically disadvantaged areas within the agency’s jurisdiction. RZH grants to local agencies are intended to supplement, and not to supplant, local expenditures for park and recreation facilities and they are not to diminish in any way the current efforts for providing park and recreation services.

The City of Brentwood has been allocated $80,288 under the Roberti-Z’Berg-Harris Block Grant Program. The first requirement of the program is the submittal of a signed resolution by the City to the State Department of Parks and Recreation. After review by the State, a contract for allocation of funds will be sent to the City for signature. Upon full execution of the contract we may submit Project Application form(s) for each eligible project up to the amount allocated within our jurisdiction. Unlike the Bond Act of 2000, there is no requirement for matching funds for this grant program.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE CITY OF BRENTWOOD TO APPLY FOR GRANT FUNDS FOR THE ROBERTI-Z’BERG-HARRIS BLOCK GRANT PROGRAM UNDER THE CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS, AND COASTAL PROTECTION BOND ACT OF 2002

WHEREAS, the people of the State of California have enacted the CALIFORNIA CLEAN WATER, CLEAN AIR, SAFE NEIGHBORHOOD PARKS AND COASTAL PROTECTION BOND ACT OF 2002 which provides funds for the Roberti-Z’Berg-Harris Block Grant Program for grants to eligible Applicants; and

WHEREAS, the California Department of Parks and Recreation has been delegated the responsibility for the administration of the program within the State, setting up necessary procedures; and

WHEREAS, said procedures established by the California Department of Parks and Recreation require the governing body to certify by resolution the approval of the City of Brentwood to apply for the Roberti-Z’Berg-Harris Allocation; and

WHEREAS, the City of Brentwood will enter into a Contract with the State of California for the Project.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood:

1. Approves the filing of an Application for local assistance funds from the Roberti-Z’Berg-Harris Grant Program under the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection Bond Act of 2002; and

2. Certifies that the City of Brentwood has or will have sufficient funds to operate and maintain the Project; and

3. Certifies that the City of Brentwood has reviewed, understands and agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and

4. Certifies that the Project conforms to the recreation element of the City of Brentwood General Plan; and

5. Appoints the Park and Recreation Director as agent to conduct all negotiations, execute and submit all documents including, but not limited to Applications, agreements, payment requests and so on, which may be necessary for the completion of Project.


PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 13th day of January, 2004 by the following vote:
