Subject/Title: Approve a Resolution for the Acceptance of Improvements for Grupe Properties Inc., Subdivision No. 8383

RECOMMENDATION
Approve a Resolution accepting the offers of dedication in fee for the right-of-way of Mills Drive, Carnegie Lane, Grisby Court, Christenson Street, Ford Street, Christenson Court, Rockwell Street, Armstrong Road (per Certificate Of Correction #2001-0153607-00, recorded on June 5, 2001) and Nunn Street for public use as shown on the Final Map; accepting the offers of dedication for all the easements, abutter’s rights, sub-surface mineral and water rights and accepting all on-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics, and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Subdivision No. 8383, Grupe Properties. Inc., located south of Balfour Road and east of Walnut Boulevard.

PREVIOUS ACTION
On May 19, 1992, the Planning Commission of the City of Brentwood approved Resolution No. 92-22, approving the Tentative Map of Subdivision No. 7736, Kaufman and Broad, with conditions.

On August 22, 2000, the City Council approved Resolution No. 2136, approving the Final Map for 52 lots of Subdivision No. 8383 with improvement securities and a Subdivision Improvement Agreement.

BACKGROUND
The Final Map is a portion of the Grupe development and is located south of Balfour Road and east of Walnut Boulevard, and was recorded on September 18, 2000, in Book 424 of Maps, at Page 10, Contra Costa County Records. The Subdivision contains 52 single-family residential lots. Prior to this subdivision construction, there was insufficient traffic circulation in the existing “Spirit and Glory”, KB Home Subdivision. Staff negotiated with the developer to provide more in and out routes for the existing “Spirit and Glory” subdivision to improve traffic circulation. All the public improvements, as required by the conditions of approval, for this subdivision have been constructed and inspected by the City inspector. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

Following are the major improvement quantities installed: 1,600 LF of sanitary sewer lines, 2,130 LF of waterlines, 2,800 LF of storm drain lines, 2,765 LF of sidewalk, 2,765 LF of curb and gutter, 54,000 SF of pavement, and 13 streetlights.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the said parcels are improved, the City must accept the improvements in order to obtain rights to the parcels offered on the Final Map. The Developer of Subdivision No. 8383, Grupe Properties Inc., has already provided a Maintenance Bond (Bond No. SU5004090 in the amount of $240,300) to cover the twelve-month warranty period for the on-site improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of approximately $9,700 for on-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the General Fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 95-5) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE OFFERS OF DEDICATION FOR STREET RIGHT OF WAY, FOR ALL PARCELS AND EASEMENTS FOR PUBLIC USE AS SHOWN ON THE FINAL MAP, ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR SUBDIVISION NO. 8383, GRUPE PROPERTIES INC., LOCATED SOUTH OF BALFOUR ROAD AND EAST OF WALNUT BOULEVARD.

WHEREAS, on May 19, 1992, the Planning Commission of the City of Brentwood approved Resolution No. 92-22, approving the Tentative Map of Subdivision No. 7736, Kaufman and Broad, with conditions; and

WHEREAS, on August 22, 2000, the City Council approved Resolution No. 2136, approving the Final Map for 52 lots of Subdivision No. 8383 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance, and the offer of dedication for public use of all the streets and parcels as offered for dedication on the Final Map are hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the offers of dedication in fee are hereby accepted for right-of-way of Mills Drive, Carnegie Lane, Grisby Court, Christenson Street, Ford Street, Christenson Court, Rockwell Street, Armstrong Road (per Certificate Of Correction #2001-0153607-00, recorded on June 5, 2001) and Nunn Street, and that the offers of dedication are hereby accepted for all easements as shown on the Final Map of Subdivision No. 8383.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.


BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
