SUBJECT: Informational report on Subdivision No. 8281 regarding improvements
along subdivision boundary.
On October 28, 2003, the City Council approved a request from Warmington
Homes (Developer) to deviate from the Density Transition Policy allowing Lot
No. 44 of Tentative Subdivision Map (TSM) No. 8281 to be reduced from the
required 20,000 square feet to 16,026 square feet, subject to the developer
meeting with the adjacent property owner (APN 019 060 030) to resolve
concerns about grading, fencing, sewer and water lateral connections, etc.
The City Council directed staff to bring back a status report at the next
City Council meeting.
Since then, staff has had discussions with both the property owner and the
developer. The developer met with the property owner and negotiated the
concerned items and brought back to staff a signed letter of agreement.
Staff reviewed the agreement and called a meeting on November 18, 2003 with
the developer and the property owner for clarification and timing of these
improvements. It was explained to the property owner that a 3:1 maximum
slope will be on their property which will extend eight feet into their
property. An enhanced fence and chain link fence will be installed as
approved by the Planning Commission and per the attached exhibit. Sewer and
water line connections will be installed prior to the issuance of the 26th
building permit for this subdivision. The agreement was amended and resigned
by both the developer and the property owner on November 18, 2003.
Grading and Improvement Plans for this subdivision are approved. During
construction, staff will work with the property owner and the developer to
ensure that these improvements are constructed per the approved plans and
the fence exhibit.
