RECOMMENDATION
Approve a Resolution approving the contract documents for the playground portion of the City Park Redesign, CIP Project No. 522-5226, and direct staff to put the playground project out to bid.

PREVIOUS ACTION
July 10, 2001: City Council approved a resolution authorizing and approving the application for grant funds for the Per Capita Grant Program under the Safe Neighborhood Parks, Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 (Prop. 12).

August 14, 2001: City Council approved the application for grant funds for the Roberti-Z’Berg-Harris Urban Open Space and Recreation Program under the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 (Prop. 12).

August 28, 2001: City Council authorized an application to apply for grant funding from the California Integrated Waste Management Board for the Park Playground Accessibility and Recycling Grant Program for City Park.

October 23, 2001: City Council authorized an application to apply for grant funding from the California Integrated Waste Management Board for the Waste Tire Playground Cover Grant Program for City Park and approved the recommendation from the Parks and Recreation Commission to use the Proposition 12 State Park Bond Act funds for use at City Park.

March 11, 2003: City Council accepted the initial conceptual design for the redevelopment of City Park, located at Oak and Second Streets, approved the use of Proposition 12 State Park Bond Act funds for the relocation and renovation of the play area as per the conceptual design and authorized the City Manager to enter into agreement with Abey/Arnold, Landscape Architects, to provide construction design services for the play area.

BACKGROUND
With City Council authorization, staff entered into agreement with Abey/Arnold Associates to develop construction documents for the renovation of the play area in City Park.

The construction documents detail the play area relocated to the southeast corner of City Park, near the current City Hall parking lot. The play area includes separate play structures for school age children and younger children, resilient surfacing for full ADA accessibility, benches, picnic tables, drinking fountain, and trash cans, gabled roof trellises as entry statements, Cooltopper shade structures, concrete walks, landscaping, and irrigation.

Construction documents are now 100% complete and Abey/Arnold Associates has completed the Opinion of Probable Costs. This Opinion of Probable Costs outlines a construction cost of $284,470 with a ten percent construction contingency of $28,447. This total of $312,917 falls within the construction budget outlined in the 2003/04-2007/08 Capital Improvement Program of $333,484.

With City Council approval of the construction documents and the direction to put the project out to bid, staff is prepared to issue the plans and contract documents for bid beginning
December 1, 2003 with a bid opening date of December 22, 2003. This will allow staff to bring the recommendation of contract award to City Council on January 13, 2004.

FISCAL IMPACT
The Opinion of Probable Cost developed by Abey/Arnold Associates details project construction costs totaling $284,470. With the standard 10% construction contingency of $28,447 added, the total construction budget is $312,917. The total construction budget falls within the approved 2003/04-2007/08 Capital Improvement Program construction line item budget for CIP Project No.522-5226, City Park Redesign of $333,484.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE CONTRACT DOCUMENTS FOR THE PLAYGROUND PORTION OF CITY PARK REDESIGN, CIP PROJECT NO. 522-5226, AND DIRECTING STAFF TO PUT THE PROJECT OUT TO BID.

WHEREAS, City Council of the City of Brentwood approved the conceptual plan for the redevelopment of City Park on March 11, 2003; and

WHEREAS, the City Council of the City of Brentwood authorized the City Manager to enter into agreement with Abey/Arnold Associates for the development of construction documents for Balfour Road Park, CIP No. 522-5226; and

WHEREAS, the City Council of the City of Brentwood approves the contract documents for the playground portion of City Park Redesign, CIP No. 522-5226;

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby approves the contract documents for the construction of the playground portion of City Park Redesign, CIP Project No. 522-5226 and directs staff to put the project out to bid.
