Subject/Title: Approve a Resolution for the Acceptance of Improvements for Brentwood Hills, Shea Homes, Subdivision No. 7882

RECOMMENDATION
Approve a Resolution accepting all on-site and off-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics, and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Brentwood Hills, Shea Homes, Subdivision No. 7882, located north of Balfour Road, west of the Hwy 4 Bypass and south of San Jose Avenue. The offers of dedication in fee for the rights-of-way for public use as shown on the Final Map; for all the easements (“S.D.E”, “W.L.” and “P.U.E”), abutter’s rights, sub-surface mineral and water rights were accepted with Resolution No. 03-2997, that has been recorded on November 3, 2003. The offers of dedication in fee for Parcels “A”, “B”, “C”, “D”, “E”, “F”, “G”, “H”, “I” and “J” were or have been accepted with the Final Map approval for Subdivision No. 7882, at the City Council Meeting on January 9, 2001, by Resolution No. 2216.

PREVIOUS ACTION
On April 2, 1996, the Planning Commission of the City of Brentwood approved Amended Resolution No. 93-59, approving Vesting Tentative Map of Subdivision No. 7882 by Termo Company for a development of 281 single family residential units.

On April 18, 2000, the Planning Commission of the City of Brentwood approved Amended Resolution No. 93-59, approving the extension of Vesting Tentative Map of Subdivision No. 7882 for a development of 278 single family residential units.

On November 8, 2000, the Planning Commission of the City of Brentwood approved Resolution No. 99-37, approving the Designer Review No. 99-05 filed by Shea Homes within Subdivision No. 7882.

On January 9, 2001, the City Council approved Resolution No. 2216, approving the Final Map for 277 lots of Subdivision No. 7882 with improvement securities and a Subdivision Improvement Agreement.

BACKGROUND
The Final Map is part of the Shea Homes development (TERMO Property) and is located on the north side of Balfour Road, west of the Hwy 4 Bypass and south of San Jose Avenue. It was recorded on September 11, 2001, in Book 434 of Maps, at Page 16, Contra Costa County Records. The Subdivision contains 277 single-family residential lots. All the public improvements for this Subdivision have been constructed and inspected by the City inspector. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

Following are the major improvement quantities installed: 12,960 LF of sanitary sewer lines, 15,460 LF of waterlines, 12,199 LF of storm drain lines, 27,000 LF of sidewalk, 27,000 LF of curb and gutter, 510,460 SF of pavement, 3.18 acres of park and dedicated 23.55 acres of open space, 10 foot wide trail through the park and open space and 80 streetlights.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. The offers of dedication in fee for the rights-of-way for public use as shown on the Final Map; for all the easements (“S.D.E”, “W.L.” and “P.U.E”), abutter’s rights, sub-surface mineral and water rights were accepted with Resolution No. 03-2997, that has been recorded on November 3, 2003. The offers of dedication in fee for Parcels “A”, “B”, “C”, “D”, “E”, “F”, “G”, “H”, “I” and “J” were or have been accepted with the Final Map approval for Subdivision No. 7882, at the City Council Meeting on January 9, 2001, by Resolution No. 2216. Now that the parcels are improved, the City must accept the improvements. The Developer of Subdivision No. 7882, Shea Homes, has already provided a Maintenance Bond (Bond No. 00-222-989-A in the amount of $9,300.30 for off-site improvements on Buena Vista Road and Wildcat Lane; Bond No. 00-223-257-A in the amount of $74,468.81 for San Jose Avenue Improvements; Bond No. 00-233-383-A in the amount of $115,300 for partial in-tract improvements (water lines, sanitary sewer, storm drain and street lights) and Bond No. 00-248-143-A in the amount of $364,100 for all other in-tract improvements to cover the twelve-month warranty period.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of approximately $74,500 for on-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the General Fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 99-7) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR BRENTWOOD HILLS, SHEA HOMES, SUBDIVISION NO. 7882, LOCATED NORTH OF BALFOUR ROAD, WEST OF HWY 4 BYPASS AND SOUTH OF SAN JOSE AVENUE.

WHEREAS, on April 2, 1996, the Planning Commission of the City of Brentwood approved Amended Resolution No. 93-59, approving Vesting Tentative Map of Subdivision No. 7882 by Termo Company for a development of 281 single family residential units; and

WHERAS, on January 9, 2001, the City Council approved Resolution No. 2216, approving the Final Map for 277 lots of Subdivision No. 7882 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
