RECOMMENDATION
Approve a Resolution accepting the work performed by Top Grade Construction Company for infrastructure work performed as part of the New Police Facility Infrastructure Project CIP Project No. 336-3110, and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 27, 2003, City Council approved and adopted the 2003/2008 Capital Improvement Program for the City. This project is included in the program as part of the New Police Facility.

On August 27, 2002, City Council authorized the City Manager to award a Construction Contract in the amount of $1,434,530 plus 10% contingency for a total contract of $1,577,983 to Top Grade Construction Company for infrastructure improvements for the New Police Facility Infrastructure Project, CIP Project No. 336-3110.

BACKGROUND
Top Grade Construction Company has completed the on-site and off-site improvements to the 1000 Central Boulevard site and has met their contractual requirements necessary to receive the contract balance left in retention. To accept and close this portion of the project, this recommendation is the procedural step to accomplish this task.

FISCAL IMPACT
The project work is complete and is within the original established budget including contingencies. Funding for the off-site improvements derive from Roadway, Sewer and Water Facility Fees, with approximately $583,000 to be reimbursed by surrounding development and the County. The remaining funding derives from Community Facility Fees.

During the initial phase of work prior to the installation of the 84” storm drain line, a cost saving agreement was established by changing the method of construction from RCP pipe to cast-in- place construction. This change saved the City approximately $25,000. The following items are change orders issued during construction:

Change Order 1 (Bore sewer line in lieu of open cut across Central Blvd.) $ 13,695.99
Change Order 2 (Sewer line installation additional work at Central Blvd.) $ 10,313.63
Change Order 3 (Joint Trench work – City reimb. and paid in full by SBC) $ 75,856.52
Change Order 4 (Joint Trench work at traffic signal location) $ 2,278.50
Change Order 5 (Additional 12” pipe – storm drain at Central Blvd.) $ 1,729.21
Change Order 6 (Concrete headwall at storm drain areas) $ 4,015.39
Change Order 7 (Excessive asphalt depths located down Walnut Blvd.
during trenching) $ 3,431.97
Change Order 8 (Relocation of existing street light conduit) $ 824.89
Change Order 9 (Additional 2” conduit at traffic signal for phone install) $ 1,659.00
Change Order 10(Revised Battery back-up box per new City standard) $ 3,335.00

The total percentage of change order work is approximately 9% of the original contract which includes the reimbursed trench work. The actual cost to the City is approximately 4% because of the reimbursement received from SBC Telecommunications.

As with all construction, there were contract line item modifications that increased and decreased due to actual quantities utilized in the field and changes to construction methods that are reflected in the projects final contract price.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY TOP GRADE CONSTRUCTION COMPANY FOR INFRASTRUCTURE WORK PERFORMED AS PART OF THE NEW POLICE FACILITY INFRASTRUCTURE PROJECT CIP PROJECT 336-3110 AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, the City Council approved and adopted the 2003/2008 Capital Improvement Program for the City which includes this project; and

WHEREAS, the City Council authorized the contract with Top Grade Construction Co. on August 27, 2002; and

WHEREAS, the project started September 2002; and

WHEREAS, the work was completed October 31, 2003 and is now ready for acceptance.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the work performed by Top Grade Construction Company for the New Police Facility Infrastructure Project, CIP Project No. 336-3110 is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for the project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did on the 27th day of August, 2002 enter into an agreement with Top Grade Construction Company for the Infrastructure work associated with the New Police Facility Infrastructure Project, CIP Project No. 336-3110.

The work described in the contract documents is to furnish all material, labor, and equipment necessary to complete said project.

On the 25th day of November 2003, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
