Subject/Title: Approve a Resolution for the Acceptance of Improvements for Ellesmere at Brentwood Lakes, Brookfield Homes, Subdivision No. 8373

RECOMMENDATION
Approve a Resolution accepting all on-site public improvements (waterlines, sanitary sewer, storm drain, fiber optics, and streets with all related improvements) for maintenance; accepting the Subdivision Maintenance Bonds and releasing the Subdivision Improvement Securities for Ellesmere at Brentwood Lakes, Brookfield Homes, Subdivision No. 8373, located north of Balfour Road and along West Country Club Drive. The offers of dedication for the rights-of-ways for public use as shown on the Final Map; for Parcels “A” and “B” in fee; for all the easements, abutter’s rights, sub-surface mineral and water rights were or have been accepted with Resolution No. 03-2997, that has been recorded on November 3, 2003.

PREVIOUS ACTION
On March 9, 1993, the Planning Commission of the City of Brentwood approved Resolution No. 93-27, approving the Tentative Map of Subdivision No. 7705 with conditions.

On May 9, 2000, the City Council approved Resolution No. 2070, approving the Final Map of Subdivision No. 8323 with improvement securities and a Subdivision Improvement Agreement.

On August 8, 2000, the City Council approved Resolution No. 2122, approving the Final Map of Subdivision No. 8373 with improvement securities and a Subdivision Improvement Agreement.

BACKGROUND
The Final Map is part of the Brookfield Homes development and is located on the north side of Balfour Road and along West Country Club Drive. It was recorded on August 21, 2000, in Book 422 of Maps, at Page 50, Contra Costa County Records. The subdivision contains 134 single-family residential lots. All the public improvements for this subdivision have been constructed and inspected by the City inspector. In conjunction with the Final Map, the Developer provided improvement securities (Performance and Payment Bonds) for these improvements. A final inspection of these improvements found them to be complete and in conformance with the approved improvement plans.

Following are the major improvement quantities installed: 4,500 LF of sanitary sewer lines, 13,160 LF of waterlines, 996 LF of storm drain lines, 10,531 LF of sidewalk, 10,531 LF of curb and gutter, 176,613 SF of pavement, and 31 streetlights.

The parcels were offered for dedication on the Final Map. When the Final Map was approved by the City Council, the offers of dedication were accepted subject to acceptance of improvements. Now that the parcels are improved, the City must accept the improvements. The Developer of Subdivision No. 8373, Brookfield Homes, has already provided a Maintenance Bond (Bond No. 219135 in the amount of $378,750) to cover the twelve-month warranty period for the on-site improvements.

FISCAL IMPACT
After the acceptance of improvements, the City will then incur costs in the amount of approximately $32,000 for on-site improvements associated with street sweeping and necessary repairs to streets and utilities. Regular roadway maintenance will be funded by the General Fund, Measure “C”, gas tax, and sewer and water maintenance will be funded through respective enterprise funds. The Lighting and Assessment Maintenance District (LLD 97-1) has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE PUBLIC IMPROVEMENTS (WATER, SANITARY SEWER, STORM DRAIN, FIBER OPTICS AND STREETS WITH ALL RELATED IMPROVEMENTS) FOR MAINTENANCE, ACCEPTING THE SUBDIVISION MAINTENANCE BONDS, AND RELEASING THE SUBDIVISION PERFORMANCE AND PAYMENT BONDS FOR ELLESMERE AT BRENTWOOD LAKES, BROOKFIELD HOMES, SUBDIVISION NO. 8373, LOCATED NORTH OF BALFOUR ROAD AND WEST OF WEST COUNTRY CLUB DRIVE.

WHEREAS, on March 9, 1993, the Planning Commission of the City of Brentwood approved Resolution No. 93-27, approving the Tentative Map of Subdivision No. 7705 with conditions; and

WHEREAS, on May 9, 2000, the City Council approved Resolution No. 2070, approving the Final Map of Subdivision No. 8323 with improvement securities and a Subdivision Improvement Agreement; and

WHEREAS, on August 8, 2000, the City Council approved Resolution No. 2122, approving the Final Map of Subdivision No. 8373 with improvement securities and a Subdivision Improvement Agreement; and

WHERAS, on November 3, 2003, by Resolution No. 03-2997 the City of Brentwood accepted all offers of dedication for public use of all the streets and parcels as offered and shown on this Final Map; and

WHEREAS, the required public improvements have been completed and are in conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements (waterlines, sanitary sewer, storm drain, fiber optics and streets with all related improvements) are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood hereby authorize the City Clerk to file this Resolution with the Recorder of Contra Costa County.
