RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute Program Supplement Agreement No. 002-M Rev. 1 to Administering Agency-State Agreement No. 04-5300 for reimbursement costs of preliminary engineering and right-of-way for the Walnut Boulevard Widening Project, CIP Project No. 336-3056.

PREVIOUS ACTION
On May 26, 1998, the City Council approved an updated Master Agreement with the State of California, Administering Agency-State Agreement for Federal Aid Projects, 04-5300.

On March 13, 2001, the City Council authorized the City Manager to execute Program Supplement Agreement No. 002-M for reimbursement of costs for preliminary engineering for the Walnut Boulevard Widening Project, CIP Project No. 336-3056.

BACKGROUND
The City of Brentwood was awarded federal funding for the Walnut Boulevard Widening Project, CIP. Project No. 336-3058 commencing with the 1997/98 fiscal year. Authorization to proceed with preliminary engineering for the project was received in late 1999. Authorization to proceed with right-of-way was received in September 2003.

Several buildings in the middle of the project area were determined to be fifty years or older, which required a lengthy historic property review by the State Historic Preservation Office. The time required for the historic property review meant that the environmental process could not be completed in time to receive authorization for construction by the deadline of March 20, 2001. In March 2001, after approval of the Metropolitan Transportation Commission (MTC), one million dollars in funding was transferred from the Walnut Boulevard Widening Project to the Brentwood Boulevard Widening Project. Program Supplement Agreement No. 002-M Rev. 1 for the Walnut Boulevard Widening project allows right-of-way costs in addition to preliminary engineering.

FISCAL IMPACT
Total federal funding for the Walnut Boulevard Widening project is $300,000. The reimbursement rate is 88.53% of $338,869 which is the total estimated cost for preliminary engineering and right-of-way. The City is required by the terms of the grant to provide matching funds of 11.47%, or $38,869.00. Passage of the resolution approving the Program Supplement specific to the Walnut Boulevard Widening project is necessary in order to submit invoices for reimbursement of preliminary engineering and right-of-way costs. Staff is researching funding opportunities for the remainder of this project.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE PROGRAM SUPPLEMENT AGREEMENT NO. 002-M REV. 1 TO ADMINISTERING AGENCY-STATE AGREEMENT NO. 04-5300 FOR THE WALNUT BOULEVARD WIDENING PROJECT, CIP PROJECT NO. 336-3056

WHEREAS, Master Administering Agency-State Agreement 04-5300 for federal-aid projects was approved by the City of Brentwood on May 26, 1998; and

WHEREAS, the City of Brentwood is eligible to receive Federal and/or State funding for certain Transportation Projects, through the California Department of Transportation; and

WHEREAS, Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements need to be executed with the California Department of Transportation before such funds can be claimed; and

WHEREAS, the City may apply for reimbursement of eligible costs, upon approval by Caltrans.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby delegates authorization to execute these necessary agreements thereto to the City Manager.

BE IT FURTHER RESOLVED that the City Manager is authorized to execute Program Supplement Agreement No. 002-M Rev. 1 to Administering Agency-State Agreement No. 04-5300.
