Subject/Title: Negotiations with public safety agencies regarding use of proposed new Police Station facility at 9100 Brentwood Boulevard

RECOMMENDATION
Authorize the Police Chief and City Manager to begin negotiations with the California Highway Patrol, Contra Costa County Sheriff, East Contra Costa Fire Protection District, Contra Costa County District Attorney’s office and other related public safety agencies on exploring the possibility of leasing the portion of the proposed new Police Station at 9100 Brentwood Boulevard that will be not be used by the Brentwood Police Department, subject to the City’s successful completion of a foreclosure action.

PREVIOUS ACTION
On September 17, 2003, the City Council authorized the City Manager to execute a purchase agreement and note and deed of trust for property located at 9100 Brentwood Boulevard (US Print) for a new police station.

BACKGROUND
The site at 9100 Brentwood Boulevard contains a 71,500 square foot building which is currently being space-planned as the Brentwood Police Department. The Police Department currently only needs approximately 45,000 square feet of the facility which leaves 26,500 square feet of excess usable office space. Several public agencies have expressed interest in having space next to the Brentwood Police Department. Specifically the East Contra Costa Fire Protection District (ECCFPD) and California Highway Patrol have given staff preliminary indications of interest. Attached is a Request for Proposals to lease office space for the ECCFPD. The Council New Police Station Ad Hoc Committee has suggested that the excess space could ideally be used by additional public safety organizations, and has encouraged staff to explore the issue. This staff report and Council acceptance simply memorializes that direction to staff. Subject to the City’s successful completion of a foreclosure action, the City Council would have to approve any Memorandum of Understanding and any lease concerning the use of the subject property.

FISCAL IMPACT
This will create a positive cash flow for the City from the long-term lease of the excess space available in the proposed 71,500 square foot police station; a potential $300,000 to $500,000 per year income to the City.
