Subject/Title: Approve a Resolution authorizing the City Manager to enter into a 0% 10-year loan agreement with Contra Costa County in an amount not to exceed $1.5 million to be spent for construction of safety improvements to Vasco Road within Contra Costa County, and placing a sunset on this loan offer in the event that construction does not start within 6 months of the date of adoption of this resolution

RECOMMENDATION
Approve a Resolution authorizing the City Manager to enter into a 0% 10-year loan agreement with Contra Costa County in an amount not to exceed $1.5 million to be spent for construction of safety improvements to Vasco Road within Contra Costa County, and placing a sunset on this loan offer in the event that construction does not start within 6 months of the date of adoption of this resolution

BACKGROUND
The accident rate on Vasco Road has increased in numbers, frequency and severity. This alarming trend coincides with a severe budget shortfall for Contra Costa County who shoulders the responsibility for the road.

This resolution continues a trend of Brentwood assisting in roadway improvements in County territory when the safety of Brentwood residents is in jeopardy.

FISCAL IMPACT
Probable cost to the general fund of lost interest of approximately $18,000 per year, reducing each year over the life of the agreement until the loan is paid off.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO ENTER INTO A 0% 10-YEAR LOAN AGREEMENT WITH CONTRA COSTA COUNTY IN AN AMOUNT NOT TO EXCEED $1.5 MILLION TO BE SPENT FOR CONSTRUCTION OF SAFETY IMPROVEMENTS TO VASCO ROAD WITHIN CONTRA COSTA COUNTY, AND PLACING A SUNSET ON THIS LOAN OFFER IN THE EVENT THAT CONSTRUCTION DOES NOT START WITHIN 6 MONTHS OF THE DATE OF ADOPTION OF THIS RESOLUTION, AND FINISH WITHIN 12 MONTHS OF ADOPTION OF THIS RESOLUTION.

WHEREAS, the Contra Costa County segment of Vasco Road has experienced 73 accidents in the last 2 years; and

WHEREAS, Brentwood’s residents are at risk every day as they drive this section of road; and

WHEREAS, Brentwood believes safety improvements need to be made to Vasco Road to reduce the number, frequency and severity of accidents; and

WHEREAS, Vasco Road is outside the jurisdiction of the City of Brentwood but within Contra Costa County; and

WHEREAS, Contra Costa County is currently researching ways to improve Vasco Road safety; and

WHEREAS, Senator Tom Torlakson, Assemblyman Guy Houston and Supervisor Millie Greenberg all strongly support improving the safety of Vasco Road; and

WHEREAS, the City of Brentwood wishes to support the efforts of Senator Tom Torlakson, Assemblyman Guy Houston, Supervisor Millie Greenberg and Contra Costa County to improve the safety of Vasco Road; and

WHEREAS, Contra Costa County is currently experiencing budgetary constraints which Brentwood fears could delay needed safety improvements to Vasco Road; and

WHEREAS, the City of Brentwood has a history of assisting Contra Costa County when the safety of the City’s residents is at stake, exemplified by Brentwood’s recent contribution of $200,000 toward safety improvements of the intersection of Vasco Road and Camino Diablo, the $1.1 million that Brentwood spent making safety improvements to Concord Avenue as well as the intersection of Walnut Boulevard and Concord Avenue, and the $1.5 million the City spent to construct the County’s new Fire Station; and

WHEREAS, the City of Brentwood’s research into safety improvements to Vasco Road disclosed a contractor with experience in the installation of jersey barriers and that the City and the contractor believe that jersey barriers may be a part of the overall safety improvement to Vasco Road; and

WHEREAS, Vasco Road may need additional road and/or safety improvements over and above the jersey barrier in developing a comprehensive safety improvement program for Vasco Road; and

WHEREAS, the City of Brentwood wants to support the County efforts toward improving the safety of Vasco Road and does not want those improvements to be delayed due to the County’s financial constraints; and

WHEREAS, safety improvements to roadways are categorically exempt from CEQA, which removes the primary delay in commencing safety improvements in a timely manner; and

WHEREAS, the City of Brentwood wishes to encourage quick action on safety improvements and thereby places a 6-month window on this loan offer.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the City Manager is hereby authorized to enter into a 0% 10-year loan agreement with Contra Costa County in an amount not to exceed $1.5 million to be spent for construction (physical improvements) of safety improvements to Vasco Road within Contra Costa County.

BE IT FURTHER RESOLVED that a sunset is placed on this loan offer in the event that construction does not start within 6 months of the date of adoption of this resolution, and finish within twelve months of adoption of this resolution.

BE IT FURTHER RESOLVED that the Finance Director is authorized to transfer funds from the General Fund sufficient to reimburse the Developer Fee accounts for interest if the AB1600 accounts are used to fund the loan.
