RECOMMENDATION
Waive second reading and adopt Ordinance No. 762 amending Chapter 2.04 relating to Time and Place of Meetings.

PREVIOUS ACTION
At the meeting held September 9, 2003, the Council discussed cancellation of the November 11, 2003 and December 23, 2003 City Council Meetings as requested by Mayor Swisher. Council subsequently waived first reading of Ordinance 762 at the meeting September 23, 2003.

BACKGROUND
The current ordinance states that Council shall meet on the second and fourth Tuesday of every calendar month and that the ordinance would need to be changed to read:

2.04.020 Meeting time designated
The City Council of the City of Brentwood shall meet on the second and fourth Tuesdays of each month for regular Council meetings. Such regular Council meetings shall commence at the time or times as specified by resolution adopted by the City Council pursuant to this chapter. Notwithstanding the above requirements of this subsection, the City Council may, prior to the regularly scheduled meeting, approve by resolution the cancellation of a regularly scheduled meeting.

ORDINANCE NO. 762

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AMENDING CHAPTER 2.04 RELATING TO TIME AND PLACE OF MEETINGS

WHEREAS, at the meeting held September 9, 2003, the City Council discussed cancellation of the November 11, 2003 and December 23, 2003 City Council Meetings; and

WHEREAS, the current ordinance states that Council shall meet on the second and fourth Tuesday of every calendar month; and

WHEREAS, the current Section 2.04.020 did not contain provisions for meeting cancellation; and

WHEREAS, in order to cancel the City Council meetings of November 11, 2003, December 23, 2003 and any future Council meetings, the City Council shall change the ordinance to allow such cancellations, which requires prior approval of the City Council.

NOW, THEREFORE, the City Council of the City of Brentwood does hereby ordain as follows:

That Chapter 2.04.020 of the Brentwood Municipal Code be amended to read:

2.04.020 Meeting time designated
The City Council of the City of Brentwood shall meet on the second and fourth Tuesdays of each month for regular Council meetings. Such regular Council meetings shall commence at the time or times as specified by resolution adopted by the City Council pursuant to this chapter. Notwithstanding the above requirements of this subsection, the City Council may, prior to the regularly scheduled meeting, approve by resolution the cancellation of a regularly scheduled meeting.

This Ordinance shall become effective thirty (30) days after the date of its passage and adoption.

THE FOREGOING ORDINANCE was introduced with the first reading waived at a regular meeting of the Brentwood City Council on the 23rd day of September 2003, by the following vote:
